Good morning all,

I have a question about AOS.

My husband has a friend who lives in Atlanta and came here on K1 visa about 2-3 years ago. She was telling him yesterday that her life with her husband is nothing but torture. At first before they got married he was the sweetest person and once she moved here he was an abuser.

She's been trying to ask for divorce and he said "no way"

Shes trying to save this marriage but he's a freaking animal and it's not happening.

He's brining his lovers/girlfriend to their house and does whatever he wants to while she's there. He measures how much spot she should be taking on their bed. They take her car out of the garage and put it on the hydrant and put his girlfriend's car in there while the wife gets a ticket. She was telling him everything yesterday and it just broke our heart. He also threatens her to send her back home all the time. She doesn't want to go back home, she has no family, no job, nothing there.

She really wants to stay here cause she already adjust to american life.

My husband is not sure but from my understanding, she's got a 2 year green card and soon she'll need her 10 year green card and then citizenship. Can she get all of it without him? I am sure if she'll tell her side of the story she could legall get everything and stay here but she's afraid to loose everything and to be sent home.

Also, even the neighbors called police on him ( i have no idea why) I think she's got one of the prooves that he's an a$$ if he has a police report.

Now, can someone please advice what can she do and how can she get her GC without him?

Sounds like a battered spouse case.

She can get divorced and get unconditional permanent residence, but she will likely need help from a lawyer and friends to get through this ordeal successfully.

yes, she's really going through and it breakes my husband's heart since he knows her for many years back from Israel.

she's trying to make it work and to save the marriage, but how can she?

he's nothing but an abusive piece of sh*t

if things are not working out between them, why can't he simply give her divorce? what is the purpose of threatening her of sending her back? so childish.

Also, they didn't meet online like most of the people did. She was a flight attendant and he really liked her on one of the flights i guess and that's how the relationship began. He was begging her to come here and live with him, so it's not like she used him for papers or it was any scam. The girl got screwed by an a$$hole.

NYGirl, your husband's friend needs to worry about her divorce right now, and then the green card. If the abusive spouse isn't cooperating, the court will grant the divorce anyways, but it may take longer. At least, it's like that in many states, I haven't found anything specific about Georgia that says it's different there. Also, Georgia allows to file for divorce on the grounds of cruel treatment.

I-751 can be approved without the spouse's cooperation. If your friend has a lot of joint documents (financial stuff, emails or letters from before and after the marriage, anything and everything that proves the marriage was real and they lived together), then I wouldn't even try to stress the abuse too much. If she has any documents (police reports, restraining orders - temp and permanent, witnesses' affidavits, medical records - official documents), she can attach all that to the petition and check two boxes - (d) and (e). If she doesn't have anything like that, she can write her own affidavit (she'll have to do it anyways), describing the marriage and the abuse, notarize it, and attach to her petition.

Self-filing I-751 is possible, lots of people do it and get approved (some even without an interview), but you have to send every single piece of evidence with it, even things that may seem irrelevant.

I would recommend hiring a good immigration lawyer, especially if she doesn't have much evidence. Just make sure the lawyer is good and exclusively practices immigration law, not something like immigration, copyright law and DUY defense. It's better to hire one who charges for services, not someone from Legal Aid. However, if she has no money (which is often the case), pro bono lawyers may help as well.

Evidence is the key. Every single piece of paper with two names on it, every single picture of the two of them together.

Finally - she shouldn't put up with abuse. No one should. She only has one life, she needs to get out of this and move on. She may end up traumatized for the rest of her life if she stays too long.

Not necessarily. It's enough to just be divorced to file I-751 yourself. Abuse doesn't have to be proven.
