Been married two years and Immigrating now

Hi folks

Here is the million dollor question for which I couldnt find an answer.

I am immigrating on CR-1. My visa was approved in Nov. By the time I arrive in America, we'll be married for just over two years (in March). Would I be given a permanent resident card (green card) with conditions or without conditions?

When you enter, be sure to politely mention that you have now been married for two years. They are able to arrange for the unconditional green card for you and should do it.

There is nothing to be sure about..... if you enter with a immigrant visa and you have been married for 2 years or more then you will be issued with a 10 years greencard.... the only people who get a 2 year conditional Greencard are people who have been married less than 2 years at the time of entry into the US....

I can't remember the names, but I've heard of the same thing happening to others, and I've seen attorneys post that it happens. I've also read the laws. All the information is consistent. The age of the marriage at the time of the visa interview determines whether you get a CR-1 or IR-1 visa. But the age of the marriage at the time you gain LPR status (that is, on the date you enter the US), is what determines whether you get conditional or unconditional status. If your marriage is more than two years old when you enter the US, whether on a CR-1 or IR-1 visa, you'll get a permanent green card with no removal of conditions required.

Sometimes they'll make a clerical mistake and try to issue a 2 year conditional card when you come in on a CR-1 visa, regardless of the age of your marriage. That's why it's important to politely remind the people at the POE that you've been married more than two years, and you believe that this means you should get a permanent green card.
