K-1 versus K-3 processing times

Timeline

Hello,

My fiance and I are very flexible about when and where we get married, we'd just like to be together, in the States, as soon as possible. He is a UK citizen, currently living in Spain. I've read a lot of the info on this site, but was unprepared when I met with an immigration attorney today who told me that the K-3 process could take about a year and a half. Since we've already been long distance for that long, we really aren't up for another stretch of time like that apart.

We have a (very small) wedding scheduled for next month, but are more than willing to continue switching to the K-1 route, if people think that would be faster. If it seems to take about the same amount of time, we'd rather go ahead with our plans as they are.

Any advice would be appreciated!

The first mistake is the immigration attorney. He's describing the typical IR1/CR1 process. I think our timeline reflects an extended K3 process.........We filed in June/July, got stuck in the July pile, approved late November with the K1 filers from the same time period, expecting embassy to receive our K3 petition mid December, and are expecting interview in late January. But yes, definitely do a little research and make an informed decision. We went with K3 but that is mainly because her family did want to see her married there.

From what I have seen in the VJ timelines the I 129F is a little faster.

From what I have seen in the VJ timelines the I 129F is a little faster.

I-129F is used for both K-1 and K-3... It can vary wildly but the lates trend appears to be that an I-129F for K-1 is shorter... Another advantage is you can file today instead of waiting until after the marriage.

I chose to go with the K1. It is a bit faster and like fwaguy said, you can file now, instead of waiting to file until AFTER the marriage.

11/15/2007 = Package sent overnight Fedex to CSC

11/16/2007 = Package arrived at CSC

11/21/2007 = NOA1 (according to www.uscis.gov online case status)

11/26/2007 = Check cashed (YIPPEE!!!!!!!!!!)

11/28/2007 = Touched

11/30/2007 = Rec'd NOA1 hard copy in the mail

12/20/2007 = Touched

12/21/2007 = Touched

03/12/2008 = Touched (due to phone call)

03/24/2008 = NOA2!!!!!!!!!

03/25/2008 = Touched

04/23/2008 = Touched

05/05/2008 = Arrived at Consulate

05/12/2008 = Picked up Packets 3 & 4

06/24/2008 = Interview Date and APPROVAL

07/02/2008 = Picked up Visa at Embassy

07/05/2008 = Arrival in the U.S.!!!!!!!!! Met at POE in ATLANTA

07/06/2008 = Fly back to Salt Lake City Together!!!!

08/06/2008 = MARRIED TODAY!!!

AOS & EAD

08/23/2008 = Package sent via USPS with Signature Confirmation

08/25/2008 = Package arrived in Chicago

08/26/2008 = Check cashed

09/02/2008 = NOA1 for EAD and AOS received in the mail.
