Timeline

OK, I won't even go into detail about how we filed the day after he got here (Sept. 29) for his SS#, and how USCIS had him down for the wrong visa, and about how the SS office didn't notice when they asked us for the wrong papers, and about how the SS office didn't call when it was rejected and sent back, and about how SS office said they couldn't call USCIS cuz USCIS "doesn't take phone calls" (give me that job, please), and about how it took 8 weeks to get his SS# and about how he couldnt' apply for jobs without it, and about how we went through living hell going through JFK just so he could get work stamp, and how it is now Dec. 4 and we just got both AOS and EAD rejected.....and those are just the highlights. I AM SO EMBARRASSED TO BE A CITIZEN OF THIS COUNTRY RIGHT NOW WHEN NOBODY CAN DO THEIR FRIGGIN JOB RIGHT, and mostly how I CALLED USCIS TODAY AND HAD TO SPEND AN HOUR ON HOLD AND CALL BACK 4 TIMES AND NOBODY COULD TELL ME WHY IT WAS REJECTED CUZ "IT SOUNDS LIKE YOU DID EVERYTHING RIGHT, BUT I DON'T KNOW CUZ IT DOESN'T SAY WHAT IS WRONG ON OUR SCREENS," and how I finally gave up and came here to get help cuz they don't know their butt from a hole in the ground, as we say down south (using worse words). OK enough venting!!!!

HELP HELP HELP---------

We spent 20.00 sending the AOS and EAD packet overnight to Chicago. Today we got it back divided into 2 packets.

The EAD said, "The application/petition you filed along with any fee you submitted is being returned to you for the following reason:

X--The check amount is incorrect or has not been provided. The correct filing fee is $340.00. Please resubmit the application/petition with the appropriate fees to the address listedo on the bottom of this notice. There was no check on this packet. We sent one check for all of it.

The AOS has the check attached (made out to Department of Homeland Security of $1,010.00) and it says:

X--The check amount is incorrect or has not been provided. The correct filing fee is $930.00. Each application between the ages of 14 and 79 must also include an additional $80.00 fingerprint fee. Please resubmit the application with the appropriate fees to the address listed at the bottom of this notice?

Could it be that I did not put "U.S." Department of Homeland Security Citizenship and Immigration Service. I swear the directions said to put "Department of Homeland Security." And the brainiacs at USCIS said I could write one check with $1010.00 on it.

I can find nothing wrong. Nobody in the USCIS hell can tell me anything wrong. That is, when you can get through to them. I had to go through all different kinds of codes just to get a human on the line. THEN they passed me on to the next person, where "the anticipated wait is 30 min. on hold." Finally I gave up and four times. Tomorrow I start again.

Any advice other than to tear my hair out? :crying:

Believe me, when this is over, I'm gonna write a scathing letter to my congressman and senators about the sorry shoddy job SS and USCIS do. This is pathetic. If I was this bad on my job, I would have been fired long ago. I keep trying to convince my husband that the U.S. paperwork shufflers are not total idiots, but so far, I have no evidence.

PS--And the grand finale was when one of the guys at USCIS suggested I drop into my local office to get this clarified. Ok, the local office is in Memphis, which is 6 hour drive away. Think I might just hop right on over there after work tomorrow---geeze..... :wacko:

I read here on VJ of a girl that had immigration write in a different visa on her I-94 (they wrote something other than K-1, I think maybe F-1 but can't recall). She had her AOS rejected as well (but she didnt site the stuff about the fees like you did), until she got it straightened out that she was to enter on a K1.

Did you verify his I-94 states a K-1? This maybe the reason you had problems with SS office and AOS filing.

I was going to recommend an infopass appointment to clarify the situation in person... until i read the part of your 6 hr drive! But the USCIS line is the mis-information line, each time you call you may get a slightly different answer.

This reads as if you sent two separate packets, one for EAD, and one for AOS. If that is the case, than it is fairly obvious why the packet was returned. When filing the AOS/EAD, they need to be filed in one big package, so that it is clear that they are together.

The other question I have is, Why did you leave off the "U.S" on the check? The directions are QUITE clear on who to make the check payable to, even going so far as to put the payee in bold type. There really was not much room there for misinterpretation.

Even if you did include the AOS/EAD in one package, which it doesn't appear clear that you did, By not writing the check correctly, it seems obvious why your package was denied and returned to you.

You should just re-file the packages, and this time follow the directions exactly.

Just wondering, did you file the EAD as a ( c ) 9 or as ( a ) 6?

Actually, I believe what the OP states is that they sent the packet and it was returned divided into 2 packets. I don't know that leaving out the "U.S." was such a big deal. So, I don't think there is anything obvious about why the application packet was returned.

No, you don't know. And I admit, I don't know for sure either. I do know that the instructions are awfully explicit on how to file the package, and how to set up the payee. The I-485 instructions also explicitly state the following...

NOTE: Please spell out U.S. Department of Homeland Security; do not use the initials "USDHS" or "DHS."

If you could put it down any old way, they would not have been so explicit on how to set up the payee. And why take the chance? How hard is it to follow the directions as they have stated them? Then, situations like this don't arise where you have no idea which of the instructions you got wrong.

Everyone makes mistakes. Even the folks at USCIS. But the OP has a lot of anger about the incompetence of the USCIS, when he/she themselves have made a few blunders too.

My "suggestion" is to follow the instructions to the letter and you'll be fine. If you do that, you will have very little to be nervous about.

Oh, come on. The instructions are long and not always easily deciphered, the entire packet is huge and confusing. Even with the sample forms on this site, there are still questions to be asked. But I'm certain that since you followed everything to the letter, you'll have no problems. :thumbs:

ACUTALLY leaving out the "US" is a BIG deal. I worked in a processing center for the IRS..and you would be amazed at how many checks had to be overstamped b/c of the payee being "IRS"--the only acceptable abbrevation is "US Department of The Tresuary"--everything had to be spelled out except the "US"....I would imagine that USCIS is just as picky.
