Hi

I am due for my K-3 interview soon and my wife is unhappy about the Affidavit of Support. She has been in bad relationships and is worried about how long she is expected to support me if all goes wrong when i get to America. Does anyone know what the timeframe is for Support so I can give her the facts?

She is responsible for you until you either become a U.S. citizen, die, or leave the U.S. permanently (and there is some other hours of work, I think 40 quarters or something like that). Even if you remarry, it does not release her responsibilities for you.

It is a very big commitment, one which I would have been scared about too, if I had been the U.S. citizen, and not the immigrant. My husband is responsible for me AND my daughter!!!! So, he must really trust that our relationship will be permanent. (And I know it will!!!!)

Nothing in life carries a guarantee, and I'm sure your wife knows that. However, sometimes you have to take some risks in order to come out with the rewards!! It's a scary step, but if you ask me, I was WAY more nervous when I was taking vows to love, honor and obey than when I was signing my name on the dotted line saying that I'd be responsible for David!

David & Erin [br]5962a06.jpg.png

6/19/2002- Met Online

11/10/2002- Met in person for the first time at Buffalo International Airport we spend a blissful but all too short week together.

2/23/03- David proposes on the beach in Melbourne Florida at sunrise during his second visit.

9/26/03- After much talk with USCIS we decide to go ahead and get married during David's third visit, with David planning on returning to Ireland the following week.

9/30/03- Phone USCIS to ask questions on filling out paper work and USCIS officer informs us that if David is already here he doesn't need to leave. After numerous calls to the Irish Embassy and two more calls to USCIS to confirm, we decide he will stay.

12/02/03- Petition for AOS recieved

10/8/04- EAD FINALLY arrives

11/10/2004- Our Son Colin Michael Kieran born two years to the minute after our first face to face meeting!

1/26/06- Recieved interview appointment letter.

3/09/06- AOS approved! David is a permanent resident with stamp in passport.

4/4/06- Green card arrives. We are now free to travel back to Ireland so David can see his family for the first time in more than two years.

Hi all,

Having talked to my wife today she has said she cant stay married to me. I know this is the wrong site to be posting this kind of thing but i dont know where else to go. I need help so I'll give the background.

I originally entered the US on a K-1 visa in November 2004 after selling my house and quitting my job. I got married to my USC wife in February 2006 but not long after following a huge fallout between her and her mother(whom I was to be employed by) she told me I should return to the UK to work until she was sure she could be married to me.

I did not have AP and eventually my wife filed the I-130 in September 05. We are now only a week away from the K-3 interview and my wife has told be she does not want to be married. She has always had insecurities about being married and the responsibilities that go along with it and even had some counselling about her anxiety.

I do not want to lose her but at the moment it sounds like I have no chance. I have been living with my sister in the UK for the past 13 months working temporary jobs every now and then to keep money coming in. I do not have a lot left and now have no house. She is now talking about divorce and I would like to know what the process is in America if she does file??

Thank you

David (UK) - Melissa (OH)

Bloody hell Dave sorry to hear that :( .......do you mean the Divorce process?.............maybe you should look online for the state she lives in!! that will give you a better idea, and she best be sure she wants this, as you are sooooo close for her to just chuck it away right before the interview!!

but you might have to consider life without her!!

Thank you Euro for you thoughts. I have started research online but of course its only brief outlines. I will continue to try and resolve matters with her while also trying to get on with my own life.

Its just not that easy when she is 4000 miles away and doesnt have to answer her phone if she doesnt want to.

This is what has brought it to a head. I dont have an affidavit of support or I probably would go. I dont know if the K1 approval I got in November 2004 would help.

Oh #######!!

well maybe you can email the embassy and ask for a later date, much later maybe, just make an excuse up, cos if she isnt serious about the divorce she is losing out as are you!!

but if she does change her mind i suppose you can always do the CR1/IR1 route!!

but i seriously do wish you GOOD LUCK!!!!

If I dont go with to the K3 interview will it affect my IR1/CR1 process??

NO i wouldnt think so too different visa's......................has your I-130 been approved yet??

but if your thinking of doing that i would email the embassy and just explain you have decided to follow the CR1/IR1 process but thanks!!

an approved I-130 can be at NVC for a while until you decide to continue the process i THINK it might be a year before they cancel it if nothing has been done with it!!

if this is what you are going to do you realy should email London ASAP!!!

I am torn as to whether to delay the K-3 interview or tell them i wish to proceed with I-130 which was approved in march. Last week, my wife said she had received info, but i dont know what and that she was going to collect the information but still wasnt sure she wanted to be with me.
