Hi guys..

I have a question about the AOS for the interview..

My hubby received a letter in the mail today saying our case was complete at the NVC (YAY) and has now been transferred to the embassy in Oz.

Because we have filed for CRI, we have already submitted the AOS reflecting tax years 2004, 2005, 2006 to the NVC. the letter we received yesterday contained a note about the interview saying the documents from the most recent tax year should be available at the interview.

It's looking like our interview is going to fall in early February but my husband says he won't get his tax return back from 2007 until mid to late February.

What do we do if my interview is in early 2008 but the most recent tax information (from 2007) is not yet available?

Any ideas? Thanks :-)

Because the tax filing deadline is April 15, I'd hope such a thing wouldn't matter unless the interview is after that, but I really don't know. As we all know, often the government makes little logical sense.

I would have copy of the W2 and any 1099s handy for interview, employers are required by law to have the W2 sent to their employees no later than January 31.

I don't think it will be required: USCIS

The sponsor must submit with the Form I-864 the sponsor’s U.S. Federal income tax return for the most recent tax year (that is, the completed tax year immediately preceding the date the sponsor signs the Form I-864). USCIS may generally expect a sponsor, after April 15 of any given year (or April 16 or 17, in a year in which April 15 is on a Saturday or Sunday), to have completed his or her tax return for the previous year. If the sponsor requested an extension, the sponsor should provide proof of filing fo r the extension. If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

Example 1 : Sponsor signs the Form I-864 on March 1, 2006. The US Federal income tax return for 2005 is not due until April 17, 2006. Therefore, the sponsor must submit his or her 2004 U.S. Federal income tax return.

Example 2 : Sponsor signs the Form I-864 on May 5, 2006. The sponsor must submit his or her 2005 U.S. Federal income tax return.

I would take tax form copy and W-2 for the last couple of years to be sure, and the W-2 for 2007 wages, and recent pay stubs. It seems that those you take plenty of info don't have any problems

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

I am currently waiting for packet 3.. when was your case transferred and do you have your packet 3 yet?

No, we are still waiting for Case Complete. Hopefully it will be completed this week. Who gets the Packet 3--the Petitioner or Beneficiary? Things seemed to be moving along, but now it seems to have slowed down a bit. Frustrating when you can see the light at the end of the tunnel...

Hi,

For anyone who is interested in updated information on this topic...

I emailed the consulate regarding the requirement for 2007 tax returns for upcoming interviews and was told that if we had already submitted our i-864 to the NVC (for tax years 2004, 2005, 2006), this would be sufficient. Info from the 2007 tax year is not yet a requirement although any recent payslips showing year to date salary information would be helpful.
