Who is in jail? US Citizen or K-1 visa holder? If the K-1 holder, this may be a big problem for AOS.

Also why is this a K-3 VISA question, your timeline shows entry on a K-1 so I will assume you are talking about AOS interview, this should be an AOS forum question.

Not to be mean; but don't they require a police record from him and isn't this going to be a huge red flag, being so recent and all?

Hi,

I need your advice, I brought my fiancee to USA through the K1 visa (I-129F) and we splitted without any formal marriage. She dumped my son on my lap and moved to another state with another man, cool with me but left my son with me. .I need your help on which form do I need to file for him and if Immigration can accept him bcos he is already overstay now.. I am a US Citizen. I called Immigration 1-800 but those guys just reading from book/internet update to me without apply some sense to it. Does he have to go back home or file for him here and if to file for him here, what forms????????

HELP !!!!!!!

I thought you left your husband and dumped your child with him? Your stories do not make a whole lots of sence.

USCitizen is the one in jail.

i am the wife, using his profile

Postponing the interview will only stave off the inevitable. From the range of posts, it appears the marriage is no longer viable. You should consult with an immigration attorney to review any options available.

If you have an extra $2,500 laying around, can I get that in a cashier check?
