getting ready to fill out the I-486 for the adjustment of status. my question is that i pay child support for three kids, so i count them and myself plus my fiance that would make 5 ? i had an attorney to get the k1 visa and on the support papers I-134 she put the 3 kids as partially dependent not wholly dependent, so im woundering how i would figure out what my poverty income should be ? when my fiance went to interview in manila they said i dont need a co-sponser and at that time i had a co-sponser. i make $28,000 year.

Note: at the visa interview the consular office can accept 100% povertyline which for 5 people is 24K, but for AOS it is 125% which for 5 is 30K.

I would get a joint sponsor.

Your tax return must be produced with your I485.

You shouldn't need to include the kids on your affidavit of support unless you are the custodial parent or unless they live with you more than 50% of the time (or possibly in certain circumstances where the custodial parent agrees to allow the noncustodial parent to claim one or more of the kids on his or her taxes). The children are not otherwise legally a part of your household (at least for tax purposes) even though you do contribute to the expenses involved in their upbringing.

As the prior poster stated, if they are not on your tax return as dependents, they do not need to go on your affidavit of support.

125% of the 2007 poverty line is $17,112 for a family of 2.

thanks, i make more then 28,000 with my over time last year i make 52,000. just started new job in april and have make 30,000 this far plus what i made from my other job from Jan-Apr. as with the kids we take turns on taxes to claim them last year i only claim one kid. i think i will still have joint sponser to be safe. thanks for info. one more question i have is when she fills out papers now that we a re married should she use my last name ?

Use the number of dependants of listed on your tax return. That's what the legal terms of your divorce are, right?
