Hello,

Our Noa2 is received on July and we were still waiting for the NVC letter.

It has been almost 5 months but still nothing in hand.even NVC did not create a file number for our case.

Today my husband called up USCIS office to check with them if there is something wrong.

I am confused please help because now USCIS is asking to fill I-824 form and pay USD340.

Do you know what is this form and why they ask this?I never read about this forum here while the people are on CR-1 visa.

04.02.2007 NOA1 received by mail

04.03.2007 touched

For some reason, they seem to be expecting you to adjust status. What did you write on page two of the I-130 petiton?

Does NOA2 say they are going to send the petition to NVC?

Did you file an I-129F for a K3 at any point?

Yes, form I-824 is the form used to direct USCIS to send the petition to NVC if they are holding it in the USA to await an I-485 adjustment of status application based on it.

If the USCIS thinks you filed an I-129F for the K3 they might hold the I-130 so they can send both approved petitions to the NVC. If you only filed the I-130 and always wanted to pursue the CR1/IR1 visa instead of the K3, then you need to fight with the USCIS so they can send the I-130 to the NVC.

Our case is CR1 (I-130) and never applyed for I-129 (K3)

Since 5 months NVC asked us to wait until they receive our papers from USCIS and they have never said we are in a different situation. Five months after they realized and asked us to contact with USCIS.

After my husband contact with USCIS they are asking him to fill I-824 out and pay USD340.

It is hard to beleive that 5 months later they realized that we are in a different situation.

Yes,NOA2 says they (USCIS) sent our paper to NVC.

So confused here..

even do not know this is good or bad to fill this form :(

Yikes... if NOA2 says they are sending it, isn't reasonable to assume they should have sent it?

Filing I-824 won't hurt things, but it is a costly service (not to mention slow too), and you should not need to file it. Of course, at this point, it is the only way to throw money in their face to get the petition over to NVC!

I wouldn't pay the $340, especially if you've only submitted the I-130. It sounds to me like it's a mistake made by the USCIS. Call the USCIS daily, get your husband's US representative involved. There should be no reason why the USCIS held onto your I-130 petition for this long.
