Letter From Employer When I'm a Contractor

Ok, I have worked onsite for Company A for a year now. I am not on their payroll. I am on an IT recruiter's payroll. However, the issue is that I have worked for 2 IT recruiters BUT AT SAME JOB AND SAME COMPANY for the year. My original idea was to have my boss (at the company) write the letter but state that while I've been onsite, I have been working through contractors. I asked him today and he does not want to get involved. (I think when I mentioned it was for immigration he got scared, I dunno). So he said have the recruiter do it since I am on their payroll anyways. I called the recruiter and they said that they would do it. but now I have to track down the otehr recruiter that I worked for before October and ask them to write the letter as well so I can show that I've been employed steadily.

Am I going about this the right way or does anyone have experience with anything similiar?

Also this month or next month there is a slight chance they won't renew my contract. If the Aff of support is not filled out before I lose my job (if they don't renew my contract but I hope they will!!) do I automatically need a cosponsor?:(

I think I would show my 1099 income and check stubs from recent pay. It's required to have a copy of the most recent years income (which will be 2007 by the time of your interview) and in your case I think I would show them the last 3 years of returns so you can establish it's a reliable income.

I'm self employed and did not have 1099s. I submitted 3 most recent years tax transcripts from IRS plus some bank statements and letter from my bank.

No problems with the embassy interview or AOS.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I'd use tax returns to as supporting evidence for the initial I-864 sent to NVC, then do an updated one with the 2007 return added or at least the 1099's. One employer letter with three tax returns should be sufficient.

I am in the same boat. I am a contract recruiter at my company...I have been there for almost 9 months but they could end my contract at any time. Let me know if you find out anything about the co-sponsor if by chance you end up out of work during this process.

Get the letter now from your current employer. Do not bother with getting a letter from your previous employer.

IDEALLY, the letter should specify the name of your employer. The terms of your employment, i.e., full time, part time, temporary, contracted and the gross amount of your annual income.

Big issue: you are a contracted employee. Immigration wants sponsors to have PERMANENT FULL TIME work. Temporary or contracted employees can not guarentee their work status in the future. So you should already be looking at getting a joint sponsor now. Even if your contract is renewed.

I was on the same boat and this is what I did. Since contractors can lose their jobs at any time, get the letter from your current contracting company ASAP (no need to get one from your previous contracting company), as long as you have it in your hands you'll be fine. Then send IRS transcripts OR copies of tax returns with copies of W2s for the past 3 years along with the I-864. That's all you need. If you lose your job any day now, the NVC nor the embassy will have to know about it.

Thanks everyone for the good advice. Diana I was kinda leaning towards your strategy as I doubt the NVC or embassy is going to ask "are you still employed" if they see my letter from current employer and last 3 years of tax returns. (2 of which I was a full time employee and not a contractor which will be good I think to at least say i am capable of finding perm work.) I just wish if the IT field would hire full time employees all the time and not contractor companies:)

Also to clear up the confusion....I am not a 1099 employee. I am still a w2 employee but my w2 will not come from the comapny i work at physically. It will come from the companies who pay me which are the recruiters.

i'm a contractor as well. i haven't received my i864 package yet, but i've started the process of getting my stuff together. i received a letter from my recruiter yesterday, but she felt it necessary to include my hourly rate as opposed to my annual salary. also, she noted that i am a contractor. do you think mention of these two facts will hurt our case?
