Getting married in USA and then trying to stay

although it is illegal....i do know someone who came here (not sure if it was purposely to get married or not) but he did, and they got married, and he hasn't left and was approved for AOS without problems.

If there was no intent, it's not illegal. If there was, THEN it is illegal.

My husband came here on a tourist visa and overstayed and married me and worked without auth, and we were approved with no problems at well. Key is, there was no intent.

I think we should create a sticky in regards to intent. We get sooo many questions/debates in regards to adjusting 'the other way.'

It's not so much that they find out your intentions, but that the burden of proof rests on you to prove at your AOS interview that there was no intent to marry when you came into the US.

The burden isn't on proving there wasn't an intent to marry but rather and intent to get married and STAY.
