Hello,

Our Noa2 is received on July and we were still waiting for the NVC letter.

It has been almost 5 months but still nothing in hand.even NVC did not create a file number for our case.

Today my husband called up USCIS office to check with them if there is something wrong.

I am confused please help because now USCIS is asking to fill I-824 form and pay USD340.

Do you know what is this form and why they ask this?I never read about this forum here while the people are on CR-1 visa.

03.27.2007 I-130 sent

03.30.2007 CSC received the I-130

04.02.2007 NOA1 received by mail

04.03.2007 touched

05.07.2007 tocuhed

06.29.2007 I-130 approved

07.03.2007 CSC sent NOA2 by mail

07.09.2007 received NOA2 by mail

09.05.2008 Case Completed

09.22.2008 Case forwarded to Embassy

09.25.2008 case at Embassy

10.08.2008 Interview

10.09.2008 passport has been sent from Embassy by UPS

10.10.2008 received passport through UPS

10.22.2008 will fly to US

Application for Action on an Approved Application or Petition I-824 $340 This form should be filed with the USCIS office that approved the original application or petition.

Wait a minute, did you get a paper copy of the NOA2? If you did, you should not file the I-824 and not let the USCIS make you do it. If you have the copy, you need to make an Infopass appointment to resolve this issue because it sounds like it was their fault they misplaced your petition and you should demand an answer.

But see, even if you didn't get a paper copy of the NOA2 and they DID approve your petition, they need to give you a valid answer of what happened to it. Is it at the USCIS? and if it is, where's the NOA2? Did they send it to the NVC and if they did, where is it?

Don't let them walk all over you without a fair fight.

Form I-824 is use to request a duplicate approval notice, to request approval notice to another U.S. Consulate, and to request notice to a U.S. Consulate for derivative visas to family members.

You should not be calling USCIS after NOA2 instead bug NVC for your case.

YES, it may take up to 6 months to get the I-824 processed.....

My I-130 was approved last September by USCIS, it was then sent to the NATIONAL RECORDS CENTER instead of NVC.

It took my congressman from October of 2008 until March of 2009 to locate it for me. To make a long story short, I had to file a I-824 and send $340.00 to get it "released" from NRC. It was then I was told that it would take 6 months for them to process my I-824.

hello friends

My I-130 was approved last 10- mar-2008 by USCIS, it was then sent to the NVC. but nvc telling they not recived papers. It took my congressman after one year they finly located my case. doing back ground check on my case

early they were asking to file I824.It was then I was told that it would take 6 months for them to process my I-824.

you can file fee waver so u can save 340 $.
