Wife arriving in US, but not moving in yet with K3

My wife received her K3 VISA back in October from the Montreal US consulate office. We will be taking a vacation in Australia before she moves into US. Her first leg of light to Australia will be a flight from Toronto to Los Angeles, therefore, she'll have to deal with the customs. Does she need to carry the document package she received from Montreal US consulate? This will be her first crossing into US from Canada after she received her K3.

Timeline

Yes activate the K-3 and turn in the brown envelope, you can continue on your trip abroad, the K-3 is MULTI-Entry visa, so it does not matter if it is used on the first leg, you can re-enter the USA after the trip to Australia because it is a multi-entry visa.

That would work but she may not actually need to clear US Customs if she's just continuing on. Either way will work.

Well K3 visa isn´t a Green Card so it shouldn´t really matter if she has it or not for these purposes since this is only a transit. She should use her tourist visa. Though if there are some problems at the border for any kind of a reason it might be useful to have the K3 packet with her. But wouldn´t probably stick it in their face in the first place just not to confuse them.

I am beginning to think I shouldn´t even be answering this since I am K1 and don´t know much about K3. But K1 is a one time visa and if u use it for the entrance you have to do in USA what it´s designed for = get married. You cannot enter twice on K1. So I hope K3 isn´t a one time use visa too, is it? I assume they place the K3 visa in the passport somewhere near the tourist visa so the officer will know about her having it anyways so it might get confusing.

Someone was trying to enter USA on a tourist visa while they already had the K1 but their wedding plans were for later so they didn´t wanna use the K1 and had some troubles at the border trying to explain why they have to enter on tourist visa...

Hm, I think I even got myself confused now lol :P:unsure:

Well K3 visa isn´t a Green Card so it shouldn´t really matter if she has it or not for these purposes since this is only a transit. She should use her tourist visa. K-3 is NOT a one time visa like the K-1, it is a multi use visa, and I would have the visa packet handy to turn in either way.

That would work but she may not actually need to clear US Customs if she's just continuing on. Either way will work.

Just to clarify, US Customs does not care so much about her K-3 but immigration does. All arriving passengers into the USA must clear immigration and be admitted to the USA... There is no such thing as a transiting the USA without first being admitted.

Yeah, shame on me for saying Customs instead of Immigration. She may be able to be admitted as a Canadian Citizen without activating the K3 but it really doesn't matter. K3 allows multiple entries.
