Hello all,

I've learned additional info around this painful immigration process on INTERNET. Like to get some feedback on this. Pros and Cons, and possible problem in future with this route. Thank you all in advance.

You can visit each other for now until August 2008. Now during these visits there is no reason for your girl to reveal that she is visiting "Fiancé" that is a no no. If she has a job and can provide job letters and pay stubs and bills etc then let her carry such info on each visit. For myself I was said i was visiting family and friends. Never did they ask about Fiancé so i was not obliged to reveal anything. if they ask tell the truth always. Even if they know that she has a fiancé in the US Her job and other ties to Canada could let her go through but there is always the possibility of denial because the Border agent has sole discretion on deciding who goes. Assuming that you visit each other until you August 08 then at that time you can get married at the court house in the US and then have your traditional wedding whenever if you want. This way it is considered a spontaneous decision to get married and then you can apply for her but she cannot leave until processing is done usually takes no more than 6 months for green card. I was to do this all over again i will do this one.

What do you want feedback on, exactly?

Hopping the border and then 'spontaneously' getting married and filing an adjustment of status?

First off, is it possible to go this route?

Yes, it is possible to go this route. After my last visit to see my fiance, I was chatting with a Canadian girl on the airplane who had done just this, and she had just received her Green Card. I think lots of people go this route. Obviously, the main benefit is that you don't have to be apart from your SO for so long. But, one major drawback is that you will not be able to leave the US or be legally able to work until you receive your green card. This girl I was chatting with hadn't worked for a year and a half. But, if you can handle it financially, it is an option that's available to you.

First off, is it possible to go this route?

Possible issues i might face during the process?

I don't see why - but citizenship is waaaaaay ahead in the process (3 years after you get married at the earliest); so tackle one process at a time.

For what I see, you'd like to go for the K-1, fiancee visa, so please :guides: so you can get a picture of what's ahead.

Agreed - my fiance and I discussed some of these other options originally, but decided that we wanted to do things the 'right' way and filed the K1. It just seems like there's alot of grey area when it come to the whole idea of 'intent' when you visit and 'spontaneously' get married. I know the K1 takes time, but this is the rest of our lives were talking about and it's too important to risk problems down the road. I'm sure most people on visajourney would agree.

If you're thinking about it now, wouldn't that qualify as "intent' right there, and not a spontaneous decision?

can one go into the USA as a visitor, get married, and stay, sure!, But if ya did that KNOWINGLY, that is illegal. Do many Cdns and other nationalities do this, yep. Each their own. we were told by a immigration attorney here in VA to do exactly that. Didnt seem right to us, and we were not in a hurry. Keep in mind if one goes that route, you won't legally be able to work and can't depart the USA (even to got Canada) Even in emergency situations such as a family member passing away. Sure ya can leave the USA, But you may not get back in, then your going to have to start at the beginning. Personally i could care less if people go that route. I'm glad we went the legal way, get much better sleep at nights. Each their own.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I completely agree. The best way is to do things the simplest way...the last thing we wanted was to give anyone an excuse to deny us of anything...even seeing each other!

Granted we have waited almost a year from start to interview date and although it has been a long road, we weighed the pros and cons and going K1 was the best way.

I have only had one instance when I returned to Canada when Customs asked me who I was visiting in the U.S and I told them my Fiance. They asked "how does that work?" and I just said we are in the process of our K1 and we met through work. No other questions, she just waved me through.

What ever you decide, better safe than sorry. Again, I would hate for anyone to be denied seeing their SO.

In the words of a USCIS officer "alot of people get away with that" (i.e. coming over to 'visit', get married, then do adjustment of status while in the states). It implies that it is illegal, but USCIS lets it slip. And just because they slack off about it now, doesn't mean that they are continuing to do that. I recommend doing things the "right" way, along with most VJers here.

If you can get married and get approved for a K-3 adjustment of status within 6 months, you may be okay. The problem is, if you are in the country for 6 months and 1 day without getting a VISA and adjustment, you have overstayed that VISA and will be denied for 10 years unless you get a waiver.

I highly suggest that you do not try this, as it is illegal and you can be charged with fraud, making any future visits to the US impossible.
