K2 without the K1 mother...

Hi,

I need your advice, I brought my fiancee to USA through the K1 visa (I-129F) and we splitted without any formal marriage.She dumped my son on my lap and moved to another state with another man, cool with me but left my son with me. .I need your help on which form do I need to file for him and if Immigration can accept him bcos he is already overstay now.. I am a US Citizen. I called Immigration 1-800 but those guys just reading from book/internet update to me without apply some sense to it. Does he have to go back home or file for him here and if to file for him here, what forms????????

You are a USC?

Why is your son also not a USC?

A K2 can only adjust if you marry the K1 and the K1 adjusts.

Was the birth registered abroad?

I have a hard time believing that the consulate would have issued the K-2 visa if they even smelled that the child is or could be a USC.... interesting to see replies from te OP
