DCF in Hungary, would my two years be eligible?

Timeline

Hi everyone,

Currently I have the K1 Visa all filled out and ready to go. I do know and understand there is the DCF and that is only for Americans who have had residency in the country for at least six months. (Well at least for Hungary its that way.)

In my situation I lived in Hungary for two years and during that time held my residency. Would any of you know if I am still eligible to go back and show my two years of eligibility even though I came back to America to attend a few semester of college?

You are required to be resident at the time of filing, you lost that by returning to the USA.

Is now a US Citizen immigration completed Jan 12, 2012.

And, as I told you in my PM response to the same question, only married people filing for immigrant visas can file DCF anyway. I-129F for K1 doesn't qualify regardless of residency.

Unless they specifically refer to past or future, USCIS instructions and regulations are written in the present tense.

Facts are cheap...knowing how to use them is precious...

DCF is for people who live abroad with their spouse. It is not for people who formerly lived abroad to petition for their fiance. It just is what it is.

In the case of Hungary, it is just the stateside wait that is long, and hard to bear. Once the petition is approved and clears the US, the process in Hungary takes no time at all. :) If you're prepared and have everything ready to go, you can be done w/ Packet 3, Medical and Interview in a month or so.
