Hi All! When my husband and I were completing our applications, in Morocco, I thought I was suppose to send the I-130 to the California Service Center. Then I was reading the USCIS website, and saw that if you live in Colorado, you are suppose to use the Nebraska Service Center. Sooooooooooo.....I sent it to the one in Nebraska. From what I can gather here.....is Vermont and California the ONLY service centers for the I-130?

I received my return receipt back, it was stamped 11/05/07, but I have not received the NOA1.

Thanks for all your help!

I-130 petitions sent to Nebraska would be transferred to California. If you plan to send an I-129F for a K3 visa, I would very carefully consider not doing so. Read these.

Don't be suprised if you don't get a NOA-1 for a long time. Mine was received in Nebraska on 8/29 and still haven't received mine.

I believe you have sent it correctly to the Nebraska Service Centre. My husband, the US Citizen, lives in WA and we also recently sent our I-130 to Nebraska, as per the instructions on the CURRENT USCIS form I-130 instructions. The instructions for the I-129F for K3, say the I-129F should also be sent there.

We have a return receipt, dated 11/21/07, but no NOA1, either.

We have heard that due to the delay in getting the NOA1's some are sending their I-129F without waiting for the NOA1 - just enclosing copies of their return receipt, I-130 and copy of their check/money order. We are still deciding if we should wait for the NOA1 or try sending the I-129F as suggested.

...so bottom line, I think you have filed correctly.

Hi to my fellow Visa Journey Families.......

UPDATE:

I called the USCIS to see if I could actually speak to a Human Being....Lo and behold I did!!

She said the following:

The Nebraska Service Center was correct when I sent it; however, they changed it to the California Service Center; therefore, all applications would have been sent to the California Service Center. As of 12/03, they have even started using the Chicago Service Center.

The NOA1 can take up to 3 months to receive. They are using the original receipt date.

I asked her if while we are waiting we should send the I-129F; she said do NOT. The reason is because 1) if you do, you have to pay the $455.00 (send a copy of the NOA1 and you do not pay a fee ... this pertains to K-3 only) 2) It could take longer, because you do not have the "A" number to include with your I-129F.

She said the AVERAGE time for a K-3 is now taking about 6-9 months; BUT, if you forget anything (for instance, not mentionin on the I-129F even one small legal infraction), it can cause your application to take anywhere from 12-18 months.

They anticipated a decline in applications when they increased the fees, in July. They even let some people go; when the opposite occurred, they received the okay to hire 1500 people to help with the applications....they have NOT been able to find "qualified" people to hire.

She also said to check the Important Alerts and Update on Processing times weekly; they are adding information each week.

Hope this helps a little.

Said and I are now trying to determine if we even want to attempt this, or if the kids and me go back to Morocco.

I'll keep you posted on any new information I find.

Thanks!

Yvette
