The USCIS didn't send it the day they said they would....it got sent out the day after. The officer who I spoke to said she was sending it as overnight mail and with saturday delivery just to make sure it would get to me in time. DHL said it was sent just by overnight mail...and that saturday delivery was not selected. The officer said she was sending it on thursday....DHL said it was send on friday....overnight wont get there on saturday unless saturday delivery is selected too. So...yeah....wont get here until monday.

I have a question if any one else has encountered or heard of this problem. I followed all of visajourneys steps for filling out the forms double and triple checked them and even went so far as to put big pink post its on each form lableing it. I sent all the forms together in one big brown envelope with a cover sheet labeling the contents. Which were the !-484, I-131, and I-765. I only received NOA1's for the I131- and I 485 even though I applied for the I-131, I-485 and the I-765. Also I received all my NOA-1's at the same time but the I-765 was missing. So when I called the USCIS they told me they never received the I-765 and I explained everything was filed at once all together. She told me that all she could tell me to do was to submit the I-765. So then the same day when I get home I find in my mail box an RFE saying I did not send in my taxes which I did send all the way back to 2004. So my questions are as follows.

1. When I resubmit the I-765 do I need to pay this time because the firts time was nocharge as long as I filed with the I-485?

2. I already received a letter for my wife's biometric appointment do we still go if we also received a RFE because of them losing my taxes?

3. Why would they send an RFE after the biometrics appointment letter isn't this out of order? wouldn't it be RFE then Biometrics?

1. yes..resubmit..what choice do you have..s.ince you already paid the $1010 fee, no need to pay more...anyone correct me if I'm wrong

I sent my (together with my daughter’s) AOS packet last Dec 28, 2007 and received a notice from post office that our papers were received by USCIS Chicago by Dec 29,2007.

Until now, we haven’t received any notice from them, even a NOA1. It’s been more than 2 weeks since Dec 29.

My husband called the USCIS this morning (Jan 23). According to the lady, USCIS is still working out of July 2007 sender applicants, which quite impossible to accept such excuse. I knew some applicants who sent AOS packet on first week of Dec 2007 & had their NOA1s now. Although, I’m also thinking that holiday season somehow is one factor why we’re having this delay.

I just want to know, anyone here sent AOS packet in between 3rd & 4th week of December. I was hoping if we can get in touch.

I really want to post this underDECEMBER FILERS Thread, but its already 21 pages. Thinking this new thread will be more refreshing for late December filers.

Hey there!

When you mention AOS you are refereing to the Affidavit of Support packet right? Well, let me tell you my experience with this. I just hung up with the NAtional VIsa center where I sent My wife's, stepdaughter and son (living in Mexico) regarding thestatus of the AOS documentation that i sent and that i haven't had any news from the visa center.

SO, maybe, but by luck, I called the national visa center (603) 334 0700 phone number and got through and talked to an actual operator rather than an automated machine.

they asked for my NVC case number CDJ XXX XXX XXXX. This kind lady immidiately checked the actual status for my three cases. Tahnk god! all three approved the AOS revision!

I filed my AOS around the 8 of january of this year (2008) and I got approved.

My reccomendation for you would be:

Always make sure you are filling everything and sending all of the documantation that they aske for. If possible, call immigration and have them clear any doubts you may have when filling forms or what you need to send.

keep calling immigration or in the worst case check online your status

and most important, be patient (but not to much jeje, bug them with questions, status, that;s what they are there for)

oh, try callin early mornings, or after six pm eastern US time. lines are less busy.

Sorry to hear that you haven't received your NOA1 yet. I am thinking it is because of the holidays. I was worried as well I had sent off my AOS packet on Dec. 21st and I got my NOA1 on Jan.4. We have Biometrics on the 29th. Hopefully you should be hearing something any day now.

hi all! i'm back after being rejected by the USCIS for 2 times. just take a look at my timeline. it's been a long wait that we thought it will never come to end. but i guess being patient reaps good things sometimes :). it seems that USCIS people are trying to make up with all the rejections and the time we lost . i can check my status online but i don't have any touches though i received my notices. my status is still the same as of december 24,2007, no emails notifications as well. is this normal?

one thing more, i have different local offices for my biometrics and interview. i wonder if it will not create any conflict with regards in processing my paperworks.

Hello everyone, even though this is my first post I have been following the December filers forum constantly. As you can see on my timeline/signature I am a December filer myself. I received very good news yesterday when I opened my mail and was surprised to find something from USCIS, I for sure thought it was a RFE but was happily surprised by it being my approved AP... yes my approved AP a little after a month and 10 days from filing!!! (Way to go USCIS :thumbs: )

So cheers to everyone and hopefully we will be having tons of approvals some time soon...

As a side note I hadn´t had any touches on AOS and EAD since Biometrics, AP was touched 01/17 and 01/18 (no e-mail alerts even though I have it activated)

Keep the good spirits and be positive!

Nope... nothing... according to the website as of today, my AP case is still pending and at the National Benefits Center... so for me the website hasn´t been that accurate
