Been married for 2 years and waiting on FBI name check

Hi,

Tomorrow it will be 2 years since I married my wife (US citizen). I've been on the FBI name check stage since January of this year. When the GC finally does go through, will I receive a non-conditional 10 year green card or a conditional 2 year GC? Isn't the 2 year conditional GC issued when you are married less than 2 years? Which I won't be after tomorrow. Also, any ideas when I should expect the name check to be over? It's already been almost a year!

what more info do you need? i've filed for AOS, got my EAD back in Jan, the only thing pending is the AOS (I-485)... already had my interview and was told the name check is the only thing left... tomorrow it will 2 years since i was married, so when i do get my GC will i get a 10 year non-conditional GC or a 2 year conditional GC? not sure what more information you need...

Howdy

Our second anniversary is tomorrow as well. We're still waiting for my husband's green card because of FBI name check. From what I understand, if you've been married for two years or longer as of the date that the application is approved, you receive a 10-year card (i.e., no need to remove conditions).

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

AOS

December 30, 2005: I-485 received by USCIS

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

To answer your other question, unfortunately, there's no way to know when the name check will be completed (my husband has a common English name). It's been almost two years since we applied for AOS. We could get good news next week, or two years from now. That's really the worst part. We've contacted senators and written letters. No one can do anything, and we're just told to be patient. And fork over lots of money to renew interim benefits.

It's starting to make me grumpy.

I am not sure how long the name check should take but there used to be a reg that the FBI had to complete it within 120 days. Have you tied and info pass?

Have you placed an inquiry and look at it this way--you;d get the 10-year card God willing. We've been married almost 3 (3rd anniv in 2 weeks!)!!! We're stuck too...we haven't even had an interview...

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

we keep getting the security check run-around from everyone. I am thinking of trying the ombusdman one last time. I have placed inquiries etc. Only got a response once..
