Can the K2 visit while I've already activated my k1?

K1/K2s are a one time entry. K2 would have to get AP or get GC if he wanted to leave the US and return.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Just looking at your timeline here, but from what I can see...you'll be interviewing for your K1 next week, and possibly moving into the US on the 17th, while your K2 is still in Canada awaiting an interview, correct?

If so, yes, the K2 can still come visit you while he awaits the rest of his processing for his visa. Just make sure he brings along the regular proof of ties to Canada. If he isn't old enough to have "ties" just make sure the border guards are assured he will be returning at the end of the visit to finish the visa process.

I'm pretty sure he can cross the border for a visit without activating his visa, you should call the POE you plan on crossing at and doublecheck.

Some other K1'ers have managed to visit the USA without activating their visa, appears to be up to the POE officer. Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

After receiving my K-1 Visa, I entered the U.S. to "visit" my fiance, before I actually moved to the U.S. I had no problems whatsoever. I did this by car, not plane.

Then, one year later, My K-2 daughter came to visit us several times before she activated her K-2 Visa and moved to the U.S. She came by car as well.

We told the border officer that we were not ready to activate our visas, but that I wanted to visit my fiance, and that my daughter wanted to visit her Mom, and they were fine with that.

I think it must be an individual decision at the various borders, and possibly different if entering by car, rather than plane.

I would try to contact the POE where your son will be entering to find out what their procedures are.
