CR Filing I-130 for Son

I have searched and not found my answer. Can a Conditional resident file an I-130 for his son? The son was over 18 when we married so I could not file for him. We know the wait is long however just want to make sure he can file before I go to the post office Monday.

Yes you can file for a son as a greencard holder....

FAMILY-SPONSORED PREFERENCES

First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.

Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent

Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:

Visa's are being issued to people with a approved I-130 dated from 2003....

Thanks Kez, So now we play the waiting game for the third son. We go to visit all of them in January Now I need to read up on the CSPA I have to see if we freeze his age some how, however he will be 21 in March 2010 and hubby applies for citizenship in June of 2010.
