me and my fiance are just comparing which visa shud we go forward too..we wer looking for k1 and for sake of considering getting married here instead in the us.we wud like to know more about on cr1.i have a son and we are concern more on if we cud bring him with me thru cr1 route..please help..we just need to know which one is better...

If you marry in a foreign country, you have to file form I-130, then you can addtionally file K-3 with the I-129 and the beneficiary (if approved) can go to the US right away and wait there while going thru visa process. Your child can also so on a K-4 visa. Here's the USCIS section on the question.

Provide dates for the following:

I-130 sent (Mailed)..........................3-12-07

1st NOA (Receipt Notice) .................3-29-07

2nd NOA (Approval Notice) e-mail.....6-15-07

Bill for I-864 processing fee rcd and sent..7-24-07

I-864 Packet Received......................8-18-07

I-864 Mailed to NV............................8-20-07

Bill for DS-230 received....................8-29-07

Payment for DS-230 sent..................8-30-07

DS-230 Packet received..................10-25-07

Child would have to have their own I-130 [CR-2]

CR visas are the best as no need to adjust status as you would with a K3/K4 or K1/K2.

LOT cheaper and a lot less paperwork and hassle.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Yes, file them together so that both are processed at the same time.

Filing together, even in the same envelope is allowed. Usually, the petitions will go through the process on the same timeline but there is no guarantee.

Facts are cheap...knowing how to use them is precious...

Pim, I believe you can only push CR1/CR2 route if your married already with a USC. I can see your timeline ur under K1 visa. I guess filing for CR1 you have to start from the first stage of the process again filing for I-130, though not sure about it. Why not finish first the K1/K2 then just simply apply for the Adjustment of Status in U.S along with ur child, at least you and ur fiancee/spouse are together alrdy. The waiting time period varies to 3-9 mos or so, same timeline of CR1/CR2 process. Good luck.

06/13/2008 : NVC received the Packets

06/16/2008 : NVC entered the I-864 & DS-230 into the system

06/19/2008 : CR2 Case Completed while CR1 got RFE DS-230 #2 & #20
