Applying for Immigration in Feb need some info please

Hello everyone :o) My story is I moved to America from Scotland 2 years ago I got married within the first year to a us citizen anyways we have not been able to afford the immigration fees but we will finally have the money at the end of Feb next year. I worried that because ive been here for so long without filing any immigration forms etc that I may get into trouble or it may effect there decision. I am applying for residency first am I right in thinking this takes about 3 months? After I become a resident do I need to apply for anything else?

Oh and 1 more thing does the fact Ive been married for about 2 years count for anything towards the length of time I need to wait or does it start from the date I apply?

Any info will be greatly appreciated this so glad I found this website :)

Overstaying a visa is not a bar to adjustment of status based on marriage, so that shouldn't give you any problems. Best not to leave the U.S. before your green card is approved, however. The fact that you've been married for two years won't make the process go faster, but it will mean that you won't have to lift conditions in two years.

You'll be filing based on your marriage to a USC. Check out the guides here: you'll need to file an I-130 and the usual I-485, I-765, I-131 package.

I don't know much about overstays, but someone for sure will help you out. What kind of visa are you in right now? Visa Waiver? Whichever it is, welcome to VJ!!!!!

I am wondering what risks you face if you came over on a visa waiver and over stayed. Where you married before you came to stay? When I have seen other posts regarding staying over on a visa waiver some have said its fraud. I am wondering???

Approximate Timeline:

Me: Lives in Massachusetts, USA

Him: Lives in Scotland

Met: July 5, 2006 online in Second Life

Met real life: November 06, 2006

Engaged: December 8, 2006

First visit face to face: 83 days-11/06/06 to 01/22/07

2nd visit face to face: 30 days 04/19/07 to 05/17/07

3rd visit face to face: 42 days 9/25/07 to 11/08/07

Contact: Daily average 4-8 hours online, on skype, and by email.

Plans: To marry in 2008

My fiance received divorce decree 2 months early! Decree completed 2/11/08

Plan to begin filing of K-1 in July of 2008! Currently gathering documents, studying information, and preparing to file!
