We were going to submit our AOS package today and just realized our NOA2 is packed away with the movers. We won't have access to the NOA2 until a week from now, but we are already 3 weeks late in filing. We have everything else, including a full doctors exam. We can include the case status from the USCIS website which states

Current Status:

Approval notice sent.

On August 12, 2006, we mailed you a notice that we have approved this I129F PETITION FOR

FIANCE(E). Please follow any instructions

Will that be enough?

You'll most likely get an RFE if you don't include a copy of the NOA2 in your package.

Best to wait the extra week so that you can include it - you can technically file "out of status" so you being late by a couple of weeks isn't a big deal.

I would wait it out. You wouldn't want an RFE! Those little pink and green letters mess your

case flow and waist a lot of your precious time!

Take your time and have a complete package!

A NOA2 is very important as Initial Evidence to prove your eligibility to file for AOS.

I'm not even sure if the absence of the NOA2 in your evidence list will mean just a simple RFE or if your whole packet will be returned for lack of evidence showing eligibility to file AOS.

Either way, I would concur with the others to just wait until you can get to your NOA2 and send a copy of it with your other evidence for AOS.

I'm not even sure if the absence of the NOA2 in your evidence list will mean just a simple RFE or if your whole packet will be returned for lack of evidence showing eligibility to file AOS.

Either way, I would concur with the others to just wait until you can get to your NOA2 and send a copy of it with your other evidence for AOS.

I think the first 'check' is just to ensure that there is payment and that there are signatures.

But I agree with everyone else. You have a three week delay without the NOA2; you're likely looking at a month or more with an RFE.

hello,

I filed my I-485 & I-765 application last january 28,09 on feb 27 iv done my biometrics... but this march 27 i received an RFE requiring us to submit some initial evidence like my husbands recent 2008 1040 and w2s, they also require us to submit recent letter of employment indicating the dates of employment, wages & salary,nature of the job,numbers of hours worked and pay stubs. We got all of that except the recent letter of employment... my husbands job has a new policy of not giving out or provide letter of employment anymore. So i just use the 2007 letter of employment and a letter of recognition of a good job well done that he just had last feb 20,09. For me i think this is way enough to show them that my husband met the poveryty line and that he has really working stable but am confuse hope you could help me and share me some good views since u guys are done with this paper works

Since you know where it is and will have it in a week, I would wait.

Though one would assume (but you should never do that) that since you also send a copy of the I-94 and the visa, that you did receive the NOA approval. Don't d'ya think? I know a few people that never got the NOA2 in the mail that are trying to file the AOS without it, but no results to report yet.
