My I-130 petition reached 180 days today. so sad.

I called USCIS today (rfe trick) and I was told that my case is not even assigned to an adjucator yet and that I "should" hear something about my case by the end of the year.

They gave me the usual run-around about how they processed cases in order received. Which we all know is not true because there's many people here, who filed later than I did, but have been approved already. I don't know why the person I spoke to felt the need to lie and make up stuff. But anyway...

Anyone else here reached 180 days and over on their I-130 petition? What's the status of your cases? I'm just curious.

We had no touches on our petition, after the transfer to CSC, until 190 days on the I-130. That is when I found out both petitions were approved at 189 days. Just hang in there, you should hear something soon.

I have been getting depressed watching those who filed before me, those who filed at the same time as me, and those who filed way after me getting approvals and there is nothing for me, not even a touch. Since I am now two weeks over processing time, I decided to give USCIS a call this afternoon. Good thing I did because they had our petition sitting in an "A-file"???? I am not sure what an "A-file" is, but it was not in a place that an adjudicator was going to look at it. She at first said that it would be January or February before it would be adjudicated. I then asked what date did they honor on the I-797, the received date or the notice date? She said, the received date. I then stated that if that is true, then my petition is out of processing time because the date on mine says May 18. She then asked if I had filed an I-129F and I told her yes, that I had to file in the middle of August since I needed another passport photo of my husband which he mailed on June 29, but it didn't reach me until the beginning of August. She told me, "Oh that makes a difference. You filed your I-129F after the fee increase so you didn't have to pay a fee. That then puts your I-130 out of processing time." She said she would pull my file and put it on an adjudicator's desk to be looked at and that I should expect a decision within the next 30-60 days. God I hope and pray it doesn't take that long!!!!! We have already been waiting for six months as it is. I have been very patient, but now I have to admit my patience is starting to wear a bit thin and it gets very depressing seeing everyone being approved and I think I am about one of the last ones on G&A's chart that has not been approved. Hopefully, this lady did as she said and maybe I will see an approval in the next week or so.

I agree Deb. Although I am genuinely happy for everyone that gets approved, I must admit that I am too, gets a bit depressed when I see people that filed after me gets approved. I really dont understand why some gets approved in two months while others sits on a shelf for six months or worse and a call from us before even getting noticed by USCIS.

Wow! I just realized how dramatic I am becoming! :help:

We feel for you too.... See our timeline below, but we went over 200 days at th CSC while another couple for the same country and visa applied at the VSC and took two months less. Honestly it is a ####### shot and the key is getting your case out of the CSC. Afterwords ours has pickup in speed. I contacted my senator at about the 4 month mark, then again after 180 days. When they called the last time, it was approved the next day. So if you haven't contacted your congressman or senator, I would recommend it.

Thanks Banfield. I'll give USCIS another week and then I'll contact my senator for assistance.

Hi! i can totally relate to how you feel. Our approval came 261 days, more or less, after we filed the I130. If not for the transfer from VSC to CSC, i dunno how long in limbo we would have been. You can just imagine how frustrated i got, everytime i read about approvals from those who filed later than we did. It caused a lot of friction between me and the hubby, but we survived the many storms.

Just hang on there and keep the faith, you'd get it soon enough.

Goodluck and God Bless!

This is truly because you did not have the picture. Its because the USCIS holds the I130 to travel with the 129f. If you would have had your pictures in order and your 129f in order, you would have already been adjudicated. Great piece of advice...? PAY THE 150 DOLLArS and have things sent with FED EX or some other world shipping. Do not trust mails.. ANd start getting your embassy papers together and signed now ( you can find out what they are and download them. I was 160 days on my I130 and my 129f never made it ANYWHERE because the lawyer messed it up

This is because you filed the 129f so late.. If you would have filed the 129f with a receipt number from the canceled check like so many did. you would have already been adjudicated. I have a feeling that you will hear something in the next couple of weeks. My NOA1 was July 2nd and I just got approved last week. Hang in there.. ( You will notice that everyone else getting approved had a much earlier NOA1 date on their 129f. They are just holding it till your 129 travels
