Hi, i am in the USA on a visa and i'm soon going to send in my i-485, my wifes petition has been in since may.

The question i have is about the medical exam required. I have two conflicting pieces of advice from friends. One says i must wait till the USCIS ask me for it otherwise the information could be out of date and the other says it's expected to be sent in with the i-485. Can anyone help me with this? If the first view is correct i'd hate to send one in and find it's out of date to were i'd need to spend more money on a new on.

FEDERAL REGISTER INTERIM REGULATIONS at USCIS website, I quote:

"C. Medical Examinations

According to 8 CFR 245.5, aliens seeking to adjust status are required to undergo a medical examination performed by a designated civil surgeon to determine whether they are inadmissible under section 212(a)(1)(A) of the Act. To date, applicants for K nonimmigrant visas have been required to obtain a medical examination abroad pursuant to Department of State regulations at 22 CFR 41.81 prior to entry, and the medical examination is not repeated if they apply for adjustment of status within 1 year of the dat e the examination was performed. They are, however, required to submit with the adjustment of status application a vaccination assessment completed by a designated civil surgeon in order to establish their compliance with the vaccination requirements under section 212(a)(1)(A)(ii) of the Act.

The Service will continue this same policy for the K-3/K-4 nonimmigrants. K-3/K-4 nonimmigrants who file their adjustment of status application within 1 year from the date of the medical examination overseas will not have to submit an additional medical examination. However, the Service notes that applicants whose medical examinations overseas revealed a “Class A†or “Class B†condition (as defined by 42 CFR 34.2( B ) ) must establish upon application for adjustment of status that they complied with those cond itions imposed on the initial admission. Failure to comply with those conditions means that a new medical examination will be required.

Your profile show you came on a CR1/IR1 if you did the why are you filing for AOS.... you should already have your greencard and had a medical in your own country before you were approved for the CR1/IR1....

If you did not come on a CR1/IR1 then what visa did you enter the US on?

Let me ask a question... your profile indicates CR-1/IR-1 visa but you are preparing an I-485 application... If this is true, why?

If not true, then what is your current status and what petition has been in since May?

Having a timeline helps prevent confusion. What visa did you use to enter the USA?

If you entered the country on a K-Visa, then you had the medical before getting the visa, and you only need vaccination supplement done for AOS.

Why wait and risk the chance of getting an RFE and causing more delays in your case's processing? I say send it in with the AOS packet as required.

USCIS will expect a Medical exam taken prior to applying and submitted to them or you will get a RFE after you apply and more delays for you. :unsure:
