hi,

i applied for a k3 a month ago after my i130 after all this time both are still pending at cali, because of the wait. i had a touch on both cr1 and k3 on 11/19 i am hoping they approve both at the same time, the officer at info pass told me it will not matter they both should still be approved together, if not the k3 should not be approved no later than 2 mos or so later. Has anyone received a cancelled k3 because their i130 was approved very early , there is somoene here who that happened to i think her name is mercy . she was told they cancelled her k3 after waiting for it to be approved some 4 mos after cr1 approval . Anyhow my god will work this out for me anyhow he has his way with each 1 of us and we are all different cases soo i just wanted to know about this it was my first time hearing that happened.Someone also told me that filing late could boost the approval and make them look at it.. but u know how ppl lie . any responses are appreciated.

Here is how I understand it. When you apply for a K3 you automatically also apply for a CR-1/IR-1. If both of them get approved at the same time then depending on how fast the processing goes.

According to what Divine Mercy said, the new policy is to cancel the I-129F if the I-130 gets approved first. So, in your case, I think that you need to see how the approval goes, either both or the I-130 first.

As for timeframes of approval I don't think there is a standard. They are not necessarily going to be approved together. It is all over the board and I do not think someone can say for sure how the approval will happen. Remember, we are dealing with USCIS, there is no method to their madness.

Here is how I understand it. When you apply for a K3 you automatically also apply for a CR-1/IR-1. If both of them get approved at the same time then depending on how fast the processing goes.

Having said that, I don't think it matters if it is policy or not. They do whatever they want to do. If you had the I-130 approved and your I-129F is still pending they are "supposed to" hold the I130 at the service center. If they send the I-130 to the NVC, start processing the CR1 to be safe. Don't waste time like I did waiting for that K3 approval. It may or may not come. I heard of a girl that had both the I130 and I129F approved AT THE SAME TIME and they told her that since the I130 was approved they were dropping the I129f. This makes no sense considering how many people get them approved together, the i129f gets sent to the NVC and the i130 gets held at the service center for future adjustment of status. I'm going to fight this termination of my I129F but I don't think I'll get anywhere with it. I'm pursing the CR1. If the K3 ends up going through then woohoo but that would be a happy surprise and we don't get those with the uscis do we?

That is messed up!! You would think they would just have one way of doing things. Maybe they should only have 1 spousal visa. That would do away with all the inconsistency.

You'll be a LOT happier in the long run with the CR-1.

Wait until you have to go thru all the hassle and expense of the K3.

Some K3s are still waiting for over a year to get their GCs and SS numbers after AOS.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Let me put it this way, If I were to file for a CR1 at the same time as another person files a K3 at the Lagos embassy. The K3 will be in america waiting for the SSC and GC while I'll still be waiting for an interview. See the dilemma?

Everyday my son continues to age w/out his father seeing a bit of it. While the K3 is sitting in america waiting for the green card, kissing their spouse, hugging their children, my husband will be sitting 7000 miles away from his family waiting for an interview. We really don't care if he is here w/out a green card or social security number and neither does my son. We only care that he is HERE. Thanks for trying to put a positive spin on it though :)

everyone situation is different, this is new about dropping the k3 anyway. Like u said dont wait that long but if u dont pay the aos bill iv fee ut can do anything... they both have to go through nvc they process as they are approved but mine will be approved together by gods grace. Most ppl are able to go k3 if it gets approved right after or so. This all depends on who u dealing with too. you should fight this they should not drop unless u ask them too. Also your approval was approved extremely fast i have not seeen anyone else that had an approval quickly while having a k3 on file, have this issue something went wrong somewhere. I guarantee they are not telling u the details but you should look into it , there may have been an error.
