Hey All

I received my interview notice for Jan 22 and I have 2 questions

1) The letter says "notice for initial interview". Is this the normal wording? Is there any reason to suspect there might be more than one based on this since they call it an "initial" interview?

2) I have heard of people's I-94's being removed during the interview. Now I am on an H1-B and obviously need myvisa to continue working. So would they take away this I-94 as well? What happens if my FBI namecheck has not been completed? Will it be removed even in that case? Of course I have the original approval notice for my H1B, so I can prove my H1B status continues even if the I-94 has been removed. Anyway just curious if people who were approved pending namecheck still had their I-94's removed

Jan 31, 2008: Email I-485 "Card production ordered"

Feb 5, 2008: Another email I-485 "Card production ordered"

Feb 7, 2008: Received I-130 approval and I-485 "Welcome to America Letter" in snail mail

Feb 7, 2008: Email I-485 "Approval notice mailed"

Feb 9, 2008: GC in hand....... (Done with USCIS for a few months) YAYY!!!!!!

Oct 22, 2009: Process starts again. Going to mail I-751 to VSC

Jan 26, 2010: Notice of Approval and Card Production for 10-year GC

Feb 3, 2010: 10-Year GC Received

1) Yes it's the normal wording. For most people it only takes one interview, but in cases where they have doubts there can be more, I guess there are only protecting themselves.

2)If you get approved, ask for the stamp in your passeport that way it doesn't matter if you don't have your I-94 (the stamp will be proof enough in the case your employeur requires some). As soon as you are approved as a legal resident you don't need your former visas anymore.

My husband had his I-94 removed yesterday at the interview. We asked for the I-551 stamp, but the officer said its not just given out so freely. She indicated to come back for the stamp in case an emergency arose and he needed to travel before the GC arrived. She didn't mention mention a pending name check though, so maybe that was complete? not sure how it goes, or if it is just standard for them to remove the I-94 at interview.

Our officer was friendly, and let us keep the EAD card (even though here on VJ I read normally most surrender it at interview), so I guess you can talk it over with the officer if you have your doubts on how long your name check may take.

Cheryl was approved at her interview, pending namecheck. The IO took the I-94. She said travel would be ok, and Cheryl could re-enter the US as long as her K-3 visa was valid, until we received the green card. I'm guessing the same would apply to H1-B. However, I don't think they'll give an I-551 stamp if you haven't cleared the namecheck.

The IO also let Cheryl keep her EAD, because we told her she was still trying to get a job. The IO gave us an envelope and made us promise to send back the EAD when the green card arrived.

That makes sense to me that they wont give the I-551 stamp if the namecheck has not been cleared. And even if they take the I-94 after my namecheck if my namecheck has cleared by the time of the interview I dont care. I suppose Im only worried about the situation where my namecheck has not been cleared at the time of the interview.

Well I suppose as long as I dont travel out of the country I'll be OK. We'll see what happens. I think I am OK to work since I still have my original approval notices for the H1B which arent invalidated by any of this. Thanks everyone
