this was the list of evidence we sent in....

copy of baby's hospital certificate (this was not the birth certificate, just the paper we got from the hospital that hubby used to add the baby to his health care insurance)

copy of baby's death certificate

I agree with James, I think they're looking for a lease (joint residence) Definitely get something from you landlord!!!

Sept 10, 2001... Arrived in US (J1)

Sept 2002... AOS (J1 to F1)

March 2003...AOS Approved

May 2003... Flew to SA. Reapplied for F1. RFE and Finally Approved. 2 year F1 visa in Passport.

Jan 21 2004... Married in Chicago

Aug 2004... Applied for AOS, Petition for spouse and EAD

Feb 2005... Joshua, our little cutie pie is born on SuperBowl Sunday

May 2005... EAD Approved

Dec 17 2005... AOS & Petition approved (2 year green-card received)

Aug 4 2007... Mailed in I-751 = $275 (remove conditions)

Aug 31 2007... Everything returned, filed too early, wrong fee

Sept 17 2007 Refiled to NSC

Sept 18 2007... Delivered by DHL to NSC

Oct 10 2007... Received at CSC

Oct 15 2007... Check cashed, transfered to CSC

Oct 15 2007... Received 1st notice with application number and 1 year extension. Notice Dated 9/19/07

Nov 1 2007... tried walk-in biometrics, refused

Nov 8 2007...Biometrics completed. Staff at Naperville ASC were great!

Nov 9 2007... Last touch

March 7 2008... Card production ordered!!!!!!!! 5 months, 2 weeks and 5 days

March 12 2008... Case Status: Approval notice sent

March 15 2008...Green card received in mail...so done with USCIS done for a few years!!!!!! :)

We spoke to our landlord on saturday and he is willing to write a letter for us.

And yes, we sent about 9 pixs , all of them including family and friends during different events

I agree with some of the comments - most notable James' - that you were a bit weak on the proof of joint residence. On top of the landlord's letter (a lease contract would certainly be better), other simple pieces of evidence - such as envelopes of letters addressed to either or both of you at said address - may strengthen that proof.

And I do believe that re-submitting the already submitted evidence along with the additional items might be a good idea as things do seem to disappear at USCIS from time to time. Make sure that you keep a copy of everything you submit and that you submit the evidence with a copy of the RFE letter and a cover letter detailing the content of your package.

Oh, and don't panic.

As Reinhard suggested, the lease agreement itself would be best. I'm assuming from your mention of a letter from the landlord that your name is not on the lease. I would see if I could get the lease agreement amended to add you on. That would likely require the involvement of an attorney (i.e., the landlord's attorney), but you might want to see if he is willing to do it.

If not, ask the landlord to execute (sign) a sworn affidavit (i.e., signed before a notary) rather than simply writing a letter. Letters are just letters, but affidavits are legal documents, and the I-751 instructions specifically refer to them. Have the landlord indicate that you WILL be put on the lease when it is renewed, or something like that.

And like Reinhard says, don't panic! Todo saldra bien, te lo prometo.

Thank you for your kind words James and friends, we did sent documents with both our names on them and showing that we live in the same address, our lease ended last June (07) and we haven't talk to our landlord about renewing it, I know sounds crazy right? but we are not planing to stay here forever plus I'm trying to convince my hubby to have a baby soon and this apartment is perfect for a couple during su 'Luna de Miel'. We did make copies of all the documents we went.

Not really crazy -- if you have an easy-going enough landlord, it happens fairly frequently. What you have now is just a month-to-month lease on the apartment, at least if NJ law is similar to Florida law. A letter -- or better yet, an affidavit -- from the landlord saying that the lease ended in June and is now continuing month-to-month (with you as a co-lessee/tenant) is what you need.

I know about living in an apartment with a baby -- Claudia and I did that with Gaby, and then when we had Santi, we had to get out. Unfortunately, that was at the peak of the housing market . . . y ahora somos pobres, jajaja.

What do you do if you don't have a lease or mortage?

I would have whoever you are living with (parents, relatives) submit an affidavit stating that you are living with them.

In addition to all the evidence that has been mentioned, we also sent Power of Attorneys. Since my husband has been away for extended periods of time (military), we got a ton of different POAs, so that I can handle financial or personal business in his name. I know that not everyone needs those... but I think that's a pretty good piece of evidence.

We got today the letter from the landlord.

And we will spend the next week gathering more documents. We have a bunch of friends willing to send affidavits of support for us, this time I'm planning to send at least 10.

The marriage certificate is always sent (required) with the AOS packet, so it's really not necessary at this stage of the game...with all of the paperwork they handle, I'm sure they don't even care to get duplicates of what they have already! :) It never hurts, but that wouldn't help at this point.

Chickie, yes..don't stress (as everyone else has said) and yet I understand WHY you are....not because you won't get approved eventually most likely...but because it's like "what MORE do they WANT!??!" Heh...I think we can all understand that feeling to some degree!

I also agree with what everyone as said about more financial proof...but I would have thought what you DID submit would be fine....ugh. I mean it's not like we all HAVE those things....I submitted joint checking account statements for 2 dif. banks and bills in both of our names and jointly filed tax returns....but we don't have a lot of the biggies most ppl do...we don't have wills, (I know, I know!), we don't have insurance, (can't afford to be without it, I know..but we reallyyyyyyy can't afford it!) and don't have mortgage/lease as we rent a home my parents own and they don't require a lease..I lived here nearly 10 years before I even met Craig.

Anyway, follow the advice here and gather all you can...but I'm sure it is frustrating to say the least....lovely ol' USCIS! :) *hug*! M.

Seriously is a pain in the neck to have to deal with a RFE specially during this time of the year.

Thanks for the idea about the Invitation, I wasn't sure about sending documents or pics from our wedding and HoneyMoon but now I changed my mind.

I'm sending TONS of pictures :whistle: , just to close their mouth and even a personalized Christmas card (the ones with our picture on it) :devil: .

Let's see what happens.
