can you file ead before you file aos

hello .. i was wondering if you can apply for the ead before the aos because my husband is offered work and i still dont have all the stuff for adjustment of status. his i94 will expire on dec 9th so i need to get started very soon . thanks alot

You can; however that is pointless as it will not be processed any faster, and it will expire with your I-94. It will not get approved before the I-94 expires, either, since that's happening on Dec 9.

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

ok thanks alot ... jus sucks my husband is already driving me nuts because he cant work ..lol and im still lost at what all i have to do for AOS and if im even filing the right papers

First off relax and take a BIG breath! Follow the guides on here for AOS/EAD and you will be just fine! I can relate with you on the driving nuts part as my husband is in the same boat! I will say that the AOS/EAD process is CAKE compared to the K1/K3 process!

At the rate USCIS processes everything, I would just do everything at once. We just received our EAD, after our AOS was approved.

K-1 & I-601 Waiver Timeline 4/7/06 to 9/12/07

4/7/06: I-129 K-1 Application mailed

4/20/06: NOA Receipt

6/23/06: Req for Evidence

8/31/06: NOA

9/28/06: NOA- NVC rcvd I-129

10/12 & 11/9: Rcvd CDJ Ltr- processing Visa

12/6/06: CDJ Interview - Denied - I-601 Waiver Required

12/18/06: I-601 filed

8/6/07: Waiver Approval

8/22/07: Waiver Approval letter received

9/4/07: Open Appointment Letter Rcvd (postmarked 8/31/07 from Texas)

9/9/07: Arrive in CDJ for Open Appt

9/10/07: Open Appointment

9/12/07: RECEIVED K-1 VISA!

AOS - 10/8/07 to 11/21/07

9/14/07: Entered the United States

9/21/07: Happliy Married!

10/6/07: AOS Packet Mailed to Chicago Lockbox!

10/8/07: Return Receipt stamped received by USCIS

10/19/07: NOA Receipt for AOS & EAD received

10/24/07: Case Online at USCIS.gov

10/25/07: Touched

11/3/07: Biometrics Appointment

11/5/07: Touched

11/14/07: Appointment Letter received

11/16/07: EAD Production ordered.

11/21/07: AOS Interview - Approved - Hubby is Legal Permanent Resident (Conditional)

11/23/07: Registered Customer's new permanent resident status (Online Case Status)

11/25/07: Touched - Production of EAD ordered (Online Case Status)

11/26/07: On November 26, 2007, we ordered production of your new card (Green Card).

11/28/07: Received EAD Card!

11/30/07: Received Welcome to the U.S. Letter

12/1/07: Received GREEN CARD!
