I am a conditional GC holder, married to an USC and we have been having some severe marital problems. I have tried to get him to go to counseling however he refuses. My husband has an anger problem. He has been physically abusive ( a couple of times in the past). He is verbally and mentally abusive more then anything. I am fed up. I love him but I am tired of being a door mat. My question is will I be able to remove my conditions? I know there is something regarding abused spouses or children, however I dont have enough proof because most of it is verbal and mental.

I could go back home, but my life is here now and I really dont have anything to go back to. Will he have to file divorce first or would I? I really dont want it to go that far but I cant take much more of him tearing up the house and calling me names. I heard that there is a waiver as long as you are divorced. Does anyone know how that works or if one would be accepted to remove conditions on that basis?

There is a program available for abused immigrants. I don't know much about it but I am sure you will get some advice here. You don't have to tolerate abuse to stay in the US. It is very unfortunate that you have become a victim of this serious problem.

How close are you to the time of adjustment?

Would it be possible to negotiate a separation?

30 June 08 Sent I751 to remove conditions

25 July 08 Application returned erroneously incorrect fee

27 July mailed new application with separate checks

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

17 Sept Mailed 3rd application with mountains of proof of error copied Senator Mel Martinez

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

Was he like this before you got your CGC or did he just recently become this way afterwards?

I strongly recommend you get out of an abusive situation, it will only get worse. The government has special considerations for this type of situation and can issue you a permanant card even if you do the I-751 by yourself. Most definitely get away from the abuse!

When we first met he was wonderful. It seems that when I moved down here shortly afterwards he started to show his true colors. I want to work things out but things have to change. I dont know if they will or not. I am so lost and confused. Part of me wants out and another part doesnt have anywhere to go. I know sticking it out and dealing with the abuse is not right but I feel my choices are limited.

This is a dangerous situation that you have found yourself in...You should not tolerate the abuse as from experience I know that it only get worse with time...You should contact the Abuse Hotline that mina76 suggested...it is important that you will get help and I am sure that they will be able to advise you of your legal situation as well...Stay well...I hope that you will be ok soon...Keep us posted, Dorothy
