Some questions about K3...

We got a Notice that our paper is being transferred to NVC (is it NOA2??) My question is, after I received a packet from the embassy, is there an expiration date for an interview? Also, after I get a K3 visa, do I have to leave for the U.S. within 90 days??

K3 visa is valid for 2 years.....(multiple visa) but once in the states might as well apply for AOS (adujtsment of status) that way you will be given a greencard.

it is your NOA2 indeed, congratulations!!! There is no expiration date for an interview. When you receive your package, you will have to fill out a couple of forms and obtain the documentation. Once all that is taken care of, you will send them a checklist and then they will schedule an interview.

You do not have to leave within 90 days. My instruction letter said to activate the visa within 6 months, but others have argues that they never heard of that.

After activation, which is done upon entry in the US, you can leave and reenter the US as often as you like within 2 years of receiving your visa.

NO you dont have to enter the US within 90days the K3 visa is valid for entry for 6 months!!

go to immigration timelines on the top on each page and you can add your timeline for statistics and such. Also, if you want it on the bottom of your replies, go to my controls, edit signature and put it in there

Thank you for your advice I cannot update Timeline. Errors come up on the date on I-130 NOA1 received and I-129F sent, is it because I sent both I-130 and I-129F together and the day I-129F send is earlier than the day received NOA1 for I-130?? Sucks sorry

Just "trick the system and say that your 129F was sent after receipt of NOA for 130. How did you send them at the same time? You need NOA for 130 for 129F package.

But just fool the timeline and make it right in your signature if you want

The reason we sent both together is the local immigrant officer said so. We were researching for the K3 process online, and some questions came up when we were filling out the petitions, so my hubby went to the office and the officer advised him to send both to Texas. I first thought it was weird since the USCIS website states I-129F is mailed to Chicago. He went to double check again, and the same officer said it is okay. I am from Japan and the officer's wife is Japanese also, so my hubby believed the officer knows what he says. We thought it could be a quicker process but actually it took way longer than it is supposed to be. As long as it is not lost, we are fine, but we learned to just follow the USCIS website

my husband did the same thing only in Charlotte, and with a lawyer here. They told the lawyer and my husband to send both to Chicago. Which he did, and then Chicago didn't know what to do with them, so they languished there for several months. We finally gave up waiting after trying to get them to find them, and we re-filed the forms correctly. This set us back a few months. We finally received the rejected forms back just about the time we were getting ready to mail in the replaced corrected ones. Without the stupid lawyer

This might be a stupid question, but receiving NOA2 means our K3 petition is approved?? Or it will be approved at NVC????

yes, the NOA2 means that the petition for the K3 (I-129F) has been approved. NVC has very little to do with K visa petitions, they send them directly on to the appropriate consulate. Then the consulate will send you Package 3, with the application forms for the K3 visa, and once they recieve those back from you, will send you a letter to notify you of your interview date.
