Hi we need urgent advice on tax income. My husband doesn't have any income for the past year (2005) and 2004 was only 7000 because he was only 6 months in the Army. 2003 is also zero because he was deployed in Iraq for a year. We got a joint sponsor who is actually my husband's uncle. Now the problem is that we found out today that his taxes income is respectively for the 3 years:

2003 17,984

2004 18,311

2005 17,361

He is single, he's not married and he has never been married. Does not have any kids or anything like that; He still live with his parents but they DON'T depend on him. he is basically a TOTAL SINGLE person.

Do you think his income his sufficient? Do you think are we gonna have any problem with the USCIS? We need an advice ASAP!!!!!!!!! Thank you!!!!

Maria, first of all BREATHE! Don't get all in a twist or you will just drive yourself crazy! The uncle only has to make $16,500 per year and judging by all three of the tax returns, he is above that. Unless his income has gone down under $16,500 this year, you are fine in regards to the uncle being a joint sponsor.

I was under the impression that our soldiers get paid even while deployed (one would hope, *especially* while deployed). Please tell me they paid your husband when he was in Iraq -- I thought they held all your pay and when you get back stateside, you get it all in a lump sum?

Go to www.uscis.gov and look at the current poverty guidelines for 2006. It's under "forms fees and fingerprints" and the Affidavit of Support section. If your husband does not make the amount for 2 people, you will need a co-sponsor. How many people are in your co-sponsor's household? I will go try to find the link for you.

8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.

First off I want to thank the people who helped me out over here. I want to answer that guy over there who was "bothering" about my husband's income of 2003. Have you ever been to Iraq?????? Sitting your bottom on the couch watching tv and live it is a total different thing, which you don't even know. Have you ever been in the Military????? If you actually answer YES I HAVE...well I am MISS AMERICA at this point. No sorry MISS UNIVERSE. I didn't ask anything about my husband's 2003 income WHICH if you can actually count a little not very much just up to 10, you would know its 3 years ago....I asked about my, sorry OUR CO SPONSOR HELLO!!!! Wake up over there!!!!!!! In this case I have to say : who r you? An immigration officer or a taxes attorney? Wake up dear the war is over

The war, unfortunately, is far from over.

Your post is unclear. People are trying to find out whose income your figures refer to, and whether or not your uncle is also military, and where the income came from. You need to have these answers before anyone can point you in the right direction.

Don't be rude to people who can help, particularly since no one said anything unkind or incorrect to you.

i agree with other that you need to relax, but i will try to answer your question.

I was also in the military (no not in Iraq) but i was also in a TAX free zone. So my income was also low (TAXABLE income) for those who dont know, if you are in the miltary and in a war zone, then your income is tax free, even if you are in the zone for one day the whole month is tax free. (Officers has diffent formulas so i dont know that).

The bottom line is i was in the military for 8 months in 2005 but 6 of them were tax free.

But also on the W-2 it will show the non taxable income that he did earn i believe it is listed at Q.

count that a income for the poverty requirments. and attach a statment, to it. And you do have to put that nontaxable income on your 1040 when you file it, (but it will be non taxable but does count for you Earned income credit).

recheck the W-2's and see what they say, the poverty requirement are for income, it does not say taxable income. I did count my tax free income, and attached a note to explain it, just incase someone did question it.

You were rather demanding in your questions, darling.

There are different requirements for AOS for military members and I am unclear from your initial post as to whether your husband is still in the military. That's why I asked you to read.

i believe the different requirments for the military when it comes to the poverty guidelines, is that they only have to meet 100% not the 125 % that others do. So that will apply to him the years he was in the military but when he did get out, it would not, dont know about the year when he was only in half of it.
