Another question regarding DS-230

I've just read the instructions to this form and now have a question.

The part that says the sponsor has to "You intend in good faith to reestablish your domicile in the US no later than the date of the intending immigrant's admission or adjustment of status. "

I'm not sure how we can do this! We're currently both in the UK, he has a job, I am a full time mother. We will have a joint sponsor of my husband's mother who lives in the US. We intend to live with her. Our children are not quite of school age yet (almost 4 and 2.5). How do they expect you to agree to a job/lease etc months before the immigrant has been approved especially as the sponsor then has to be with me at point of entry?

Also, my MIL is going through a divorce from my FIL. Will that affect her being our sponsor? If it does we're stuffed argh!

1998 - 2000 - Long process with Immigration obtaining Green Card #1.

11/Feb/2004 - Child #1 born

14/Jul/2005 - Child #2 born

August 2007 - Decide we need to move back to USA. Kicking self for not getting citizenship.

24/Sep/2007 - I-130 sent

28/Sep/2007 - I-130 NOA1

12/Dec/2007 - I-130 Approved

11/Jan/2008 - Police Certificate applied for

11/Jan/2008 - DS-230 part 1 sent off

14/Jan/2008 - Medical booked for Jan 21st

21/Jan/2008 - Medical in London - all clear!

24/Jan/2008 - Statement of readiness sent to embassy

09/Feb/2008 - Police clearance arrived

14/Mar/2008 - Interview at 9am!! APPROVED!

18/Mar/2008 - Visa arrived!

22/Mar/2008 - Being made homeless!

23/Mar/2008 - Flight to USA!!

12/Apr/2008 - Greencard arrived!

Done with immigration until I can apply for citizenship in 2011.

No need to stress about this bit really. All it is saying that you intend to establish domicile upon entering the US with your husband - which you do. It's okay that you will be living with your mother at first. It's referring to the date of admission to the US with the visa, not the date of applying for or receiving the visa. :)

As long as your MIL has enough income on her own, the divorce should not effect anything. If the divorce is not final before she signs the I-864 though, your FIL will need to be included in the household number. But I think you said she makes $32,000 (unless I'm confusing you with someone else) which is still plenty even with the FIL included in the household number. :)

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
