Bugging me!!!!!!!!!!

This is something that has always bugged me....I basically know that i'm right but there is still a drop that worries me.

When I filed I filed a I129F K1 petition.....My la wyer told me that her son who is 5 is part of the petition and that i didnt need a separate petition for him.

The USCIS website says the following:

I-129F Petition for Alien Fiance(e) K-1/K-2 - Not yet married - fiance and/or dependent child .

It says " AND " dependent child....

Please tell me im right!!!!!!!

You and your lawyer are right.

For us, going through Thailand (though at this point at your journey...it is the same...because we're all going through USCIS at this point), we listed my fiancee's children as a part of our K1 petition for my fiancee. There wasn't a need/requirement to complete another I-129F for her children. You're on the right path!

Breathe easy <grin> My USC darling man... filled out our I-129F and on it is listed all 3 of my children... we didn't need to fill out a separate application for them...

The separate "stuff" comes from the time of the interview onward... The dependent child will need to have ALL of those extra things filled out separately (such as the DS156, the G325, the medicals and all the rest)...

But not to stress out right now, and as the time comes - you can always ask here and everyone will help you out...

In the meantime just make sure that your fiancee' has her childs' full birth certificate on hand and ready... Along with a Affidavit or Court order that will allow her to move her child O/S...

When your petition gets to the consulate and you receive packet 3, you will submit a seperate visa application for the K-2 and pay a seperate fee....

I FAXED SOME STUFF TO THE EMBASSY ALREADY!!!!!!!!!!!!!!! I FAXED A COPY OF LEIDY'S PASSPORT, THE 0F-169 FORM, DS-230 PT 1 FORM .....I HOPE YOU MEAN THAT AT THE TIME OF INTERVIEW I HAVE TO HAVE THAT

DO YOU MEAN 2 156 AND2 156 K FORMS .....FOR LEIDY AND DANIEL????? 2 EACH THAT IS??

That is exactly what I mean... The derivative benefit is for qualifying to apply for the visa based on the parent's approved I-129f petition. In the eyes of the consulate the K-2 is a seperate visa applicant that will require there own application forms. That is what we had to do.

PLEASE TELL ME THAT DOESNT MEAN THAT I HAVE TO START THIS PROCESS FOR HER SON NOW....SHE WILL NOT COME AND LEAVE HER SON IN COLOMBIA...THIS WOULD KILL ME!!!!!!!!
