Anyone denied entry at POE before?

Hello,

Im nervous because my husband is about to have his interview scheduled at Frankfurt. Long story short, he came to visit me and marry me under the Visa Waiver Program last year in December. At the Port of Entry in Dallas, the immigration officers questioned his intention in the US. He pretty much told them he was visiting. But that contradicted to what I told the same immigration officer. When the immigration officer called me on my cell, he asked if I knew him and what were our intentions. Honestly I did not know about the restrictions with the visa waiver program or any immigration laws at that time, but I told the officer he was coming to visit me for my promotion and graduation to becoming a Staff Sargeant, we were getting married in Las Vegas and we were going to file the paperwork once we were married so he can legally reside here. Im such a dummy. They denied him entry and he voluntary went back to Germany. A couple of months later I went to Germany and got married to him, claimed him as my dependent although he is not living with me (he has his military dependent ID card) at the moment and I visited him a couple of times last year and this year. I just would like to know if anyone has gone through this and any advice on what we should do. Thanks very much. :help::help:

Lots of people get denied entry at POE, its really no big deal. Just be sure that he is truthful about it on the DS forms and at the interview, because they will have record of it.

They stamped on his passport in Dallas :

VISA WAIVER PROGRAM REFUSAL

pursuant to 8 CFR 217.4

I researched it but I really dont understand much of it. All I know is that the immigration officer said that I can file a K-3 and get him here as my fiancee, but now that we are married we persued the I-130 and the K-3. At this time my husband received packet 3 and is about to send it off.

I think you should contact an immigration lawyer. From what I have seen he will need to bring a waiver before hand to the interview. It sounds to me like they suspected immigration fraud. He told them he was visiting and you told the CBP Agent that you were getting married and he was going to stay. That's a BIG problem.

If I am not mistaken, didn't you say in another thread that he was handcuffed and detained?

He was handcuffed and detained, but their reasoning behind that, from what they explained to him, they had no room to keep him at the airport while he was waiting for his flight back to germany. He spent the night in jail and flew the next day. I will have him call the embassy just to be sure if he needs that waiver.
