My wife and I completed our AOS (I-485) interview on 11/14/07 at the Chicago office. The officer asked my wife and I a few questions (how/when we met, when we were married, and my wife for our phone number which she didn't know off hand without retrieving her cell phone) and took our bank statement, driver's licenses, car title and marriage certificate as evidence. The officer did not care to see our photos.

There was no decision at the end of the meeting. The officer indicated that she was going to do some additional background checks and then would provide a decision within 90 days.

I see that most people who post here received their decision on the spot at the end of the meeting - should we be concerned?

Also, the officer removed my wife's I-94 form from her passport and my wife will be traveling out of the country with just her advanced parole document/passport - will this be a problem?

Thanks for your help!

The Advance Parole will allow your wife to travel. It isn't uncommon for an office to mail the decision. After all, as I discovered during our interview in San Diego, our IO usually worked in the Naturalization section, though as they were trying to close early due to the Thanksgiving Holiday, everyone was pitching in to assist other areas of the office. Wishing you a speedy response in your favor.

We had our AOS interview on Aug 1 and are still waiting to for our decision. Our attorney told us not to worry, that he would start to worry at the 6 month mark. I'm not too happy with it, but security checks may take a while. Have you got EAD? If so you may want to be prepared to refile for it just in case.

I found this while researching the AOS process:

http://www.visajourney.com/faq/k1k2visa-aos.html

6.7.1)....Well, my wife received her advance parole documents today. I had thought maybe we would receive some instruction on how to use them properly from USCIS (INS), but no such luck. She got three sheets; one original with picture attached, one copy with picture attached and one copy with no picture attached.

A....When your spouse leaves the USA, she should have all three copies (of the advance parole document) and her passport. The first time your spouse re-enters the USA, the POE will forward one of the copies of your letter to the office or service center you applied for AP from. You should receive the copies labeled TO TRANSPORTATION LINE and TO ALIEN back. If you enter the U.S. on some carriers, it's possible that the "transportation line" copy may be lifted from you. (FAQ Note: another poster mentioned on Aug 17, 2000 after returning from the UK "The airline (US Airways) didn't want the "To transportation line" and the INS guy left it too so I now have the top copy with the photo and a "To transportation line" should anyone want it in future.")

The USCIS (INS) at the POE should also place a stamp in her passport like this:

PAROLED until:

Purpose:

Port: Date: Officer:

__________________________________________________

They will stamp both copies of the AP when you use it for the first time. They will keep one copy and give one back to you.

You only need a valid passport and the AP document to get back in. That being said, if your wife gets a new passport it would probably be a good idea to bring the old one or at least a copy of the ID & visa pages.

AP is valid for one year from the date of issuance.

Yes, you can use it as many times as you want, as long as it is still valid.

The first time you use your AP document, the immigration officer will stamp it, as well as stamp your passport. After the first time, you will only need to show your passport with the AP stamp in it.
