We recieved a pink slip yesterday (Request for Initial Evidence for the I-485).

What it asks for is as follows:

G. x (24) In order to Process your application further, the petitioner/sponsor on Form I-864, Affidavit of Support, must submit all supporting tax documentaion (W-2s, 1099s, etc) submitted to the Internal Revenue Service (IRS) for the most recent tax year.

I. x (25) In order to process your application further, the joint sponsor on Form I-865, Affidavit of Support, must submit all supporting tax documentation (W-2s, 1099s, ect) submitted to the Internal Revenue Service (IRS) for the most recent tax year.

I. x (27) The joint sponsor on Form I-864, Affidavit of Support, Must be a United States Citizen, United States National, or Lawful Permanent Resident of the United States.

In order to process your application further, submit evidence of the joint sponsor’s status.

As far as the co-sponsors tax forms, well we sent in copies of the last three (3) tax years in our packet just behind the appropriate I-864. For me, I had no tax return from the last tax year and so included (1) a letter typed by me stating why I had no taxable income and therefore did not file that year... signed and dated and (2) the actual tax transcript from the IRS that states:

"We recieved a request dated October 23, 2007 for verification of non-filing of returns for above tax period or periods. We have no record of a filed Form 1040, 1040A, or 1040EZ using the above Social Security Number. You can consider this letter a verification of non-filing."

I don't know what else I can send for these two items!?!?!

And as for the request for proof of Citizenship for the co-sponsor... well that I can do.

I think what frusturates me the most is that we were soooo meticulous while putting together the AOS packet and even included a cover letter for the AOS packet as a whole as well as individual cover letters for the different sections and applications.

Oh, I guess we're dealing with humans who just like us can make errors sometimes.

We go in for our biometrics tomorrow and I was able to get an INFOPASS appointment just an hour before that so I can count ourselves lucky with that.

Get Tax transcripts from IRS. 1 800 829 1040. 24/7. Took me 7 days to get them via snail mail.

You can also have them faxed to you if you are in a hurry.

IN regards to the tax returns you send USCIS does not say it but it is implied by USCIS(and I Am sure you will have many on here try to point out it only asks for one year of tax returns but then why does USCIS give you the option to submit two more years worth of tax returns right under that selection if you only need 1 year worth of tax returns, I mean there is a implied reason whether anyone wants to face up to it or not), they will expect you to submit a photocopy of each W2 and any 1099s with your tax return for 2006, 2005, 2004 and also any supporting schedules or forms you filed with the tax return. And same thing for the joint sponsor. I know it is stupid, especially if you are submitting the last three years worth of IRS tax transcripts with this(since it is what matters and is official record of IRS), but they want it for some reason. Also if you have not make sure you contact IRS and get 2006, 2005 and 2004 official tax transcripts to submit for you and any co sponsor. Not sure on proving joint sponsor status of residency or citizenship, probably best to send in a photocopy of their passport or maybe birth certificate if you can. I feel for you, it is frustrating, but you have to bomb those people at USCIS with supporting paperwork and lots of it. Good luck.
