Reporting Marriage and Tourist Visa

I just recently married in Peru 2 weeks ago! Now I am back in the States. I have a few questions I wanted to throw out there.

1) I have the marriage certificate and its corresponding translation, do I need to report these documents to my state to change my marital status? Would this affect my K-3 visa application if I do not report my marriage?

2) We were think about, while waiting for the K-3 visa process of her trying for a tourist visa to come and visit me before she gets her K-3 visa. Would this hurt our chances for the K-3 visa, especially if they deny her the tourist visa?

Also why not investigate the CR-1 visa, it directly results in a green-card issued. No EAD or AOS hassle and $1010 fee.

Compare CR-1 to K-3 visa timelines, in most cases CR-1 takes a bit longer.

that's a good question

if you get the tourist visa going before the K-3 it will be aproved, but if you get the K-3 before the tourist visa, the tourist visa will be deny and they will wait for the k-3 process(sorry one of my friend went through this issue).

Also if you apply for the tourist visa and get deny, depend on the person, they might look at it wrong way and deny it, which is not looking good for your case. but my friend got a lawyer and get her case approved again so either way she will be here for you.

Next: playing the waiting game for the 2 years holding removal

Congrads on the marriage! I am engaged to a wonderful Peruvian women who is set to arrive in 30 days.

About the tourist visa. This visa is very tough to get in Peru. My fiancee tried to get one before we were engaged and was denied very quickly. And some of her friends and family have been denied also.

The person has to make a good case to the embassy that they will get on a plane and go home. However, in your case it will be double hard to convince the embassy that she has a good reason to go back to Peru since she is already married to an American living in the states.

I have no idea if trying to get a tourist visa will hurt your K-3. Guess you can give it a try but it may turn into a waste of money.

Congratulations on your recent marriage! I would file the paperwork ASAP and unfortunately, its a process... The best is for you to visit your spouse.. The embassy will probably deny the Vistor Visa since they are married to an American Citizen. Its a painful process... Best of luck and I hope you have good journey... :thumbs:
