How long before you have to Adjust?

Just wondering if there is a deadline or time line that must be followed for AOS.

We got married within the 90 days and have sent the papers for adjustment but they returned them for wrong amount for filing fees.

Now its been a while to get up the funds to make up for the new amount and we are wondering if we are in trouble.

Obviously the sooner the better but a few have waited up to 1 year or more with no apparent repercussions.

Re-file when you have the correct funds available. Why would you want to wait? The fees took a big jump in July this year and they could rise again at almost any time. The USCIS is one agency that is suppose to pay for itself with the fees it collects.

You have the first filing for AOS to accomplish and then two years later after AOS you will be filing for permanent status. Those fees for removing conditional status changed from $275 to $545 in July too. So, why wait? You could miss out on another fee increase because of delays. It is not going to get cheaper in the future.

It takes at least six months for a fee increase to go through.

Don't worry about a fee increase, but doing AOS sooner rather than later is recommended.
