Well, I'm glad to see you are feeling better.

I'm shamefully ignorant of the process through Lagos. It sounds like hell and I'm sorry you have to face that.

BUT....if it is as you say, that working right away when he does arrive in the US is important.....then this CR1 will be a long-run blessing for you.

Kathryn, many times here at VJ I catch flack for the very short visa processing time my husband and I had. It's true I haven't suffered the long separation times that many here have gone through. I know my husband and I weren't very good at being apart and I know that even though I can sympathize with you, I can't really relate to what you are going through.

That being said, I can testify to how difficult adjustment of status can be for K1/K3 beneficiaries after they arrive in the states, and how that can add unnecessary stress to the immigrant's adjustment, and to the marriage. I can tell you personally how frustrated we were to be turned down for mortgages because my husband did not have his residency; how employers didn't quite understand that a one-year EAD was as legal as a greencard; and how after a certain period of time some people who knew us started wondering why the government wouldn't issue my husband a greencard - what was 'wrong' with him?

When your husband arrives here - finally - on his CR1 - he will not have to endure any of that. He will arrive with greencard in hand. No one will unduly question his legal residency. No one will suspect his character. Employers will recognize that he is 'good to go' and won't think he's only in the country for the duration of his EAD. You will be able to begin your belated future as a 'regular' couple - the government won't be holding you back.

Hang in there. Your post today alarmed me.

Let me tell you this - this archaic, backward process is not WORTH being beat over. For me, I was determined that if my government continued to hold my husband a virtual immigration hostage, that they would eventually hear my voice. I've spoken with senators, congresspeople, and lobbyists over the issues that face all of us each day. I even had a short radio blip - it was pretty hysterical. DO NOT LET THEM GET THE BEST OF YOU! The public might be blissfully ignorant of immigration; they might be overly paranoid of terrorist types and they might be hellbent against 'illegals'. But I've never met ONE citizen, who when I sit down and explain to them what LEGAL immigrants go through to come to this country, that wasn't truly amazed, shocked and disgusted. There is a larger voice out there available to you - god forbid you should need it in this fight.

Wow. Thank you for that. Things are better, like I said before, I JUST found out when I typed that first post. That's what caused the double post too.. I was a basketcase. It was like watching my life fall apart but thanks to VJ people I've come to see that I can pick up the pieces and make another plan.

I'm so sorry your husband had to endure all of that. Thank you for speaking out about this nightmare to people who really do think "all you have to do to get in the US is marry someone". If there is ever anything I can do to help you in the awareness endeavour please don't hesitate to ask (I'm not really a suicidal drama queen... unless you threaten to take away my husband lol). Last night one of my friends said, "don't take offense at this, but what did you really expect to happen? After 9/11 and because of all the scammers in Nigeria, they're never going to let him come here". I didn't punch him so kudos to me. I tried to explain that 9/11 isn't really an issue because if it were, a guy at my parish wouldn't have been waiting 12 years to bring his wife and children over from Sri Lanka (they'll be here in Jan. thanks be to God!). The scam artist problem is faced at the embassy level. It was the whole attitude, which seems to be common. "What did you exect" a.k.a. no one really cares if you and your son ever have him here, you shouldn't have married a foreigner in the first place.

I'm happy for one thing, for now, I'm done with the USCIS. The NVC may not be better but it's different and that's a tiny blessing in itself.

I refuse to believe that. With these security checks, you just don't know how long it could be. Don't let them forget you, keep pushing and screaming. A squeeky hinge gets the oil (or something like that).

Oh Divine Mercy, that was such awful news :( I was really worried for you after reading your first post. This process, no matter how hard it is, is not worth a person's life. Even at the worst times, there are still things to be thankful for (your husband, your children), it's just hard to see the positives when the bad things seem so large and overwhelming.

I've read through the whole thread and am glad to see you have mustered the strength to continue on. You are not starting from the beginning, you are already past the hard stage and you've achieved so much to get to this point. You've found the positives for your current situation and they will be better for you in the long run.

Compared to the length of time you have already been forced to wait (3 years before being able to apply), the extra few months are not going to be as bad as what you have already endured. I am truly hopeful that the wait for an interview at Lagos is much less than the VJ estimates have shown. You will make it through this hard process and it will all be worth it in the end.

you're very right. We've already gone so far, to stop now would have been ridiculous. It's not that much longer. Its just that they love to keep pulling that happy ending back a few inches to keep it out of your reach. Sometimes it gets so tiring. Thank you so much C&J. I hope we both get our happy endings soon than expected.

Ok this post has sent me in a panic mode...I am in the same situation since my I-130 was already approved last September thus awaiting for the pending I-129F which was submitted last July which had 2 touches already. I have a young daughter whom we weren't able to apply the I-130 for because we didn't know that we have to apply for her separately anyway, we got an advice from a senior VJ that we need not apply for her separately, since time is of essence to us we just need to wait for the approval of 129F then just go on a K3-K4 visa...but having read this post my husband called USCIS and was told that...we would get denied with I-129F because we didn't apply a separate I-130 for my daughter....what is really the real score?

We were told by the senior VJ that we could file the separate I-130 for the daughter when we get to the US so now it's all confusion....how sure is this new policy of I-129F termination if there's an I-130 approval beforehand? DivineMercy, were u able to file a separate I-130 petition for the child as well?

Any reaffirmation on this termination policy? thanks.

Kathryn's (Divine's) child is a USC and thus needs no I130. The USCIS misinformation line seems to have given you some misinformation at least. . The part about "we would get denied with I-129F because we didn't apply a separate I-130 for my daughter" is not the reason why your I129F would be cancelled. It would be that your underlying I130 for your spouse is no longer pending.

VJer Neenuh was in the same situation when her I129F was ended. She had not sent a I130 for her son, thinking she would submit it with in time for AOS. Then she had to send it in after the I1129F was ended.

The advice to hold off on the I130 wasn't bad. Usually applying for a K3 forces you to get a K3, so it makes sense. Unfortunately, you ended up in the situation where your I129F was sent a month and a half after your I130, and almost a month after you got the NOA1 for your I130. They quickly adjudicated the I130, leaving your I129F to wilt. This killing the I129F in these situations appears to be a fairly recent scenario.

If I were you, I would file an I130 for my child, after first making sure that like Kathryn, your I129F is not going to be adjudicated. Either way, sending the I130 for the child is not gonna hurt.

I got the approval notice of my I-130 (NOA2) and the receipt notice of I-129f (NOA1) both on the same date Sept. 14. Is it safe to say that they know that my intention to submit the I-130 for my daughter is when I get to the US? That both cases are clipped together? Thanks.

We really just want to go on with the K3 because we would rather do the paperwork together and K3 seems much faster. But the question of the termination policy is unsettling...that if it is really true...they sometimes give false information.

RFE trick is where you call USCIS customer service line and select through to the option that says you received a mail from USCIS that you do not understand (an RFE). Then you are connected to a rep at the service center who actually can look at your file and give you real answers if they want to be helpful. That is how Kathryn found out her I129F was canceled.

As for receiving the notices on the same day, it doesn't mean much. If the receipted your I129F probably right before they approved your I130, they did not know about the I129F when they approved the I130. So they weren't thinking anything about K3s.

If they had approved the I130 right before receipting the I129F, they would have seen that you no longer had a pending I130 and would have returned the I129F to you. So your I129F got in the system. If they had linked the 2 petitions, your I130 would not have been sent to NVC.

Was your approved I130 sent to NVC? Did you get the DS3032 and Affidavit of Support bill? This should have happened by now. If not, then they are holding your I130 for later, and you are probably still on the K3 path, but you need to RFE trick to verify.

Since jimandjosil have an approved I-130 they could call USCIS using the approved petition option to ask about the I-129f. This option gets you to a human also.
