Can a Canadian file K1 visa from outside the country?

Hello.. I recently got engaged to an American citizen and is hoping to live with him soon in the states.

My concern is... i'm a canadian citizen studying in Korea... about to graduate med school in February. So, I can't leave this country until I write the boards exam in January and graduate in February. But I would like to file for K1 visa as soon as possible so I can marry my fiance in US ASAP.

I tried calling the US consulate in Seoul to ask whether I can file for K1 visa here in Korea as a Canadian citizen, but they never answer the phone!! :wacko:

So I decided to ask people on this forum... your advice would be greatly appreciated.. since I would like to start things fast...

and another question.. as for going through police checks, I lived in Canada, Korea, and went to University in the States for 4 years. I know I have to send in police checks for canada and korea, but do I also need to do this for the 4 years I attended university in the states?

I'm very much confused about the whole process... and don't know where to start.. PLZ help!

Before you can apply for the visa, the USC must file an I-129F petition. The petition will need to be approved and forwarded to the immigrant visa section at the consulate where you are residing. Only then will you be able to submit your application for the visa and be interviewed by the consulate.

Are you planning on moving back to Canada after you graduate in February? If so, you can have your K-1 Visa interview in Canada.

Your fiance will file the I-129F petition from the U.S., and it most likely will not be approved for a few months. After the approval, then the visa interview is scheduled. If you plan to be back in Canada after you graduate, you should be able to time it right to have your interview after you return.

Yeah, it'll be quite a while before you're at the interview portion of the process. No idea what current processing timelines are like, but it'll be more than 6 months probably.

You will need police certificates from Korea and Canada, not from the US. Any time spent living in the US will be covered by background checks they do on you as a matter of course during their processing.
