Timeline

When we entered the united states, they had taken all the required documents and we have yet to get any back. Has any one had this happen before?

K-1Visa

April 07, 2007 NOA1

September 13, 2007 Visa issued

March 13 2008: "Welcome to America" approval of AOS letter

March 21 2008: Green Card Arrived

January 21, 2009: Apply for mother and father in law's visitor visa

January 22, 2009: Visa Issued

November 2010 Brother in-law applied for diversity visa

January 19, 2011 Applied for Citizenship

April 14, 2011 Citizenship Interview-Passed

June 3, 2011 Citizenship Certificate Received

If you are talking about the brown envelope, this is normal, the documents get sent to USCIS where they wait for your AOS petition.

If you are talking about the brown envelope, this is normal, the documents get sent to USCIS where they wait for your AOS petition.

Then how am I supposed to file the i-485?

It requires criminal history (submitted at the interview and in the brown envelope)

Birth Certificate (in the brown envelope and we have no copies!) (They have the original)

Avidavit of Support (in the brown envelope)

DO WE HAVE DO GET EVERYTHING A SECOND TIME!

and we have no way of getting the birth certificate!

HELP!!!

HELP!!!

1) Police cert: USCIS has it, and not required for I-485 filing.

2) We had several copies of birth cert for future use in the states. USCIS only needs a photo copy of it.

3) You use a new affidavit of support for AOS, this time I-864 or I-864EZ, NOT I-134.

Yeah, they did the same to us. Now we're scrambling to get a new vaccination supplement before we run out of time.
This too is standard procedure for K-Visas, every one needs to get vaccination supplement done by a civil surgeon, per the directions included with form I-485.

yuandDan, another question about the affidavit of support. We have to file two total! How ridiculous! This is incredible! I figured the adjustment of status would be way easier than filing for the visa. ugh. You sound very knowledgable. Any other advice?

USCIS will perform a name check, you only need police cert for the K-Visa interview at the consulate, NOT for AOS.

We followed the guide, and were approved without any problem, (NO Police Cert Needed) USCIS got it from the consulate in the Brown Envelope.

Consulate used the NON-Immigrant I-134 affidavit of support, it only is for period of time from entry until becoming an immigrant (Green-Card holder)

Green-card requires the stronger I-864 affidavit of support, we just recycled the financial evidence and attached to the I-864, no notary needed, so I-864 is just a matter of filling out the form, and attaching copies of IRS returns, a few pay stubs, and perhaps an employer letter to it. Ours was a simple case so we used the I-864EZ form.

Exactly why is it ridiculous ? I don't understand why everyone feels like they have the right to be mad about the paperwork. Next time, marry a US citizen and you won't have to deal with paperwork.

I, personally, think that the AOS is a pretty straight-forward and easy process, it is time consuming, but other than that it is extremely easy.

04/19/07 - Touched AGAIN DAY 12

04/20/07 - Biometrics appt notice received (05-02-07) DAY 13

04/27/07 - I-130 Touched DAY 20

05/02/07 - Biometrics (Took us 8 minutes - no kidding) DAY 25

05/03/07 - I-485 Touched DAY 26

05/17/07 - Interview letter arrived (07-17-07) DAY 41

07/17/07 - Interview - Everything went well but received an RFE DAY 102

08/28/07 - RFE sent - Took a long time to get what they needed DAY 144

08/29/07 - RFE received - DAY 145

10/04/07 - Email: Notice welcoming new resident mailed - DAY 180

10/05/07 - Touched - DAY 181

10/09/07 - Welcome Notice received. - DAY 185

10/10/07 - Card production ordered. - DAY 186

10/17/07 - Green card received !!!!!!!! - Day 193
