give me some advice

i am new new to this site and i am so depressed thinking about our situation...ive been married since july 2004, my husband is a US Citizen from wisconsin after we get married hes planning to stay here in the philippines for good and planning to start a business to make some money but after being here for 2 years we found out that what we plan as business will not make enough money to make him stay here so we decided to let him go back to the states to look for a job and start the paper to get me there but he read on the website that we cant use the K3 because were married for 3 years plus already so maybe we need to use IR 1 or CR 1 i dont really whats the right visa for me...BUT the real problem we had is he dont have tax return for 5 years since 2001 he just starting working right now but still not enough for poverty set by the goverment but my brother in law is willing to be my co sponsor....Does co sponsor work in my case? please any advice will help and information can help me for being so depressed all the time...thank you and God bless you...

In general the processing time for K-3 and IR/CR1 are about the same---this from my Immigration Attorney. AS for your question about Co-Sponsor--yes it applies to your case. Good Luck!

Take it from me....GO TO THE AOS INTERVIEW DATE ANYWAY!!!!! EVEN IF YOU GET THE SNAIL MAIL NOTICE!!!

August 2009--Permanent Resident Card arrives!!!!

We are Finished with Immigration for 10 years!!!!

thank you Mary K...it help me for being so stress for my situation....

yeah u can use a co -sponsor , and yes its better to applied CR1/IR coz when u approved u dont have to undergo adjusting status which will cost you 1010$ , if u have kids he can apply also for I-130 , but also be careful about the I-864 the affidavit of support he should be able to get more than one people depend on poverty line and depend on his salary and his sponsor , good luck

thanks for the reply guys it help me so much for the stress i am facing now...i am so worried for my husband that he dont have income tax return for 5 years...i wish having a co sponsor will back up of this problem.....

So tell him to file the taxes for the last three years right away. He will not owe any tax as long as all his income was foreign income.

You will need his tax transcripts eventually, regardless of who's income is used to meet 125% poverty guidelines.

Right now... you need to file I-130 urgently, because it will take months for it to be approved.

CR-1/IR-1 is the best visa option possible and so this is what you should be going for.

June'07 NOA2 per USCIS website!

Waiver I-751 timeline

July'09 Check cashed.

Jan'10 10 year GC received.
