hola,

I need some help and was told about this places. I was given a k-1 over 15 months ago, but my fiancee decided to not marry.

It was a unique situation , because he spent more time with his friends than me and left me alone alot, sometimes not even

sleeping with me as he was addicted to Television. Even though he had OCD, i loved him, but he asked me to leave and said he changed his

mind. I had friends here in the US and stayed with them untill my visa was ready to expire and then went to Canada by means of a friend.

Although I left the USA before the visa expired, I dont enter Canada with visa. now problem ???

I have met a great guy in my home in Cali while he was on vacation and we are engaged now and I told him everything what happen and he trust and believe me which good. But, Will I have a problem at the interview because of this ? I have proof I was in Canada before the k- expire and than 3 months later, i return home to Cali, Colombia

Can you peoples help to give advice for me ??? Gracias !!

I no explain good. My original k1 was from USA and we not married. I left usa and go to Canda and stay with friends for a few months.

But I did leave US before my USA K1 expired but went to Canada instead of going back to Cali.

I go to my home in cali 3 months later after being in canada.

2 years later I met my US fiance in Cali and he file a K1 for me. This is the second k1 application.

please to understand, english is so so.

The issue would be that since you entered Canada without a visa, I take it you entered Canada illegally, so have no exit stamp in your passports proving you left the US before your I-94 (not visa) expired. What kind of proof do you have that you were in Canada before your 90 day stay in the US was granted?

Your visa expiration date is not the issue. The expiration date on the I-94 is. For instance, if your visa was issued January 1, it expires in six months, so June 30. If the visa holder enters the US February 1, their I-94 is going to expire April 30 regardless of the June 30 visa expiration date.

So, what evidence do you have that you left the US before your I-94 expired?

I have paycheck copies and letter from my employer, proving I was in Canada before the i-94 expired in the USA.
