Our I-824 went in a week before our AOS packet. The post office confirmed it was delivered the 25th of October to the Texas Service Center.

Still no NOA nor has the check been cashed. I waited the obligatory 30 days and called the 800 number today. After a long, drawn out conversation, their statement was that the Texas Service Center is SEVERELY backlogged and it may be another 30 days before they even open our letter, much less send on a receipt and cash the check.

Now, your opinions please. We initially sent a letter with the AOS package explaining that we had filed the I-824, but were awaiting delivery of the NOA2 Approval of I-129f. We got a RFE last week asking for the I-129f approval. The 800 contact today told me to just draft a letter and send with the RFE explaining the backlog and that it may be 6 more months before we ever see the document.

So, what do you think? Since we have 80-odd days left to send the RFE, should we wait for a while and try to at least wait on a receipt with the RFE, or just draft the letter and send it on and hope for the best?

Unfortunately I have no advice for you, I havn't gotten to that point where I really know enough about what you're talking about to give you advice. BUT I do have a question for you. If you file you AOS but get and RFE, does it count that you filed within the required time, and you are okay? I am worried we will be missing a document, but if we file now without and get an RFE, as long as we file before the 90 days is up, will we be okay?

You are under no absolute requirement to file within the 90 days (marriage is the only must) ... It is however good to do so as soon as possible in order to receive the next level of immigration benefits.

I'm trying to figure out what an I-824 is. And what order you filed your filed your documents in.

Missing his I129F NOA2 for AOS purposes and the I-824 is the application to get a replacement document

I had to file an I-824 for the same reason you did, but we waited the almost three months until we received it before filing for AOS. I think you probably should have atleast waited until you got the NOA1 for the I-824 so that you could have sent that in with your AOS paperwork as proof that a replacement NOA2 was ordered. But, hindsight it 20-20 and that doesn't help you now, so I would wait a while (maybe till you have a month left to send in your RFE) and if you still haven't received the NOA1 for the I-824, then send in a letter and hopefully that'll be enough for them to understand what's going on.
