Hi,

I had my AOS interview last Nov 8. The interviewer took the I-94 from my passport but did not stamp it. She said to just wait for my greencard in the mail. My question is, I am going to the Philippines in two days, will I have any trouble with the immigration officer because I don't have my I-94? Help please!

You should not go on the trip without your green card or AP. Do you have Advanced Parole granted, for travel? If so, you can travel. Otherwise, you will probably NOT be able to re-enter USA. Be careful!

Thanks for the response. I forgot to mention I'm on K3 visa which is a multiple entry visa so I don't need Advanced Parole according to the USCIS website. I am really worried about having the I-94 taken out of my passport though.

Thanks for the response. I forgot to mention I'm on K3 visa which is a multiple entry visa so I don't need Advanced Parole according to the USCIS website. I am really worried about having the I-94 taken out of my passport though.

The IO at your interview made a mistake taking the I-94 out of your passport.

They did the same thing for my wife and anak [K3/K4].

Told us they'd have to to get AP if they wanted to be able to return to the US if they went out of the US.

You can't return to the US without the I-94 or have your GC .

Edit!

If you are leaving in 2 days your only chance is either to walk in where you had the interview and get them to stamp the i-551 in your passport.

It's there mistake and should do so.

Was your interview in Honolulu?

If so I think I have the phone number for the USCIS office here.

Thanks to everyone who posted replies. They were all very helpful. I was able to get an infopass appointment this morning and talked to an immigration officer. She said that my case status is still pending so I can travel on my K3 visa, no need for AP. I do have to bring my notice of receipt for I-485 as proof that my AOS is pending (thus the reason they took my I-94) to the airport.

Well they told you it was OK to travel without the I-94 and AP and the IO told us it wasn't OK without the I-94 and AP

That's another reason I don't trust much of anything USCIS personnel says.

I guess you will find out when you try to come back.

Hope the IOs at the airport are on the same track.
