I am a USC married to a German citizen. We are planning on moving home next Spring and have received the DS-230. We are go about the immigration process through DCF in Frankfurt since we reside in Germany.

What exactly do they want from me in response to the DS-230?

Do I need to send copies of our documents as proof that we're prepared for the interview or do they only want a filled out DS-230 and checklist saying that we have all of our documents?

Also, we have a daughter who has dual citizenship. Is their anything that we need to do in particular for her? Especially when it comes to the I-864?

I would appreciate any help and tips.

A few things about I-864.

You count daughter as dependent NOT immigrant on the I-864, if daughter has US Citizenship.

You will need to provide past year's IRS return, or a good reason why you did not file one.

You will need to show US Domicile for the I-864.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

I am not sure what you mean by what they would need in response to the DS-230. You only need to fill it out when it is sent to you in Packet 3, if you file by mail. If you file at Franfurt, you probably would fill this out cocurrently with the Embassy along with submitting your I-130 and G325a with USCIS Frankfurt. It is faster to file in person, however, since time isn't exactly of the essence, you could do it fine by mail. See my time line for more info about mail in applications. Mine wasn't in reality that slow. He could have been here as soon as the first part of July.

You child would not need to be sponsored. However, your child would be counted in your household for the I-864. Remember only income from US sources or income that has been proven will continue in the US can be listed on the I-864. I had to get a co-sponsor. Your wife's or husband's income will not count unless it also has been proven that it will continue in the US after the ben. immigrates. If you have substantial financial assets, you could list those on the I-864 in lieu of income. Otherwise, you will need a co-sponsor or come before your SO to the US and find a job that meets 125%poverty guidelines for your household size.

Been a long day. OK, I see you are talking about the checklist. This is telling the embassy that you have the documents necessary to perform the interview. All it is is saying that you have them. You will only need to provide the documents from the checklist at the interview and not before.

I still have a few more questions...

I originally came over as a student and after graduating got married and unexpectedly got pregnant shortly after. I haven't worked ever, however my parents said they will be joint-sponsors. They are financially in a good place, but I'm concerned that my lack of job/iincome could be a disadvantage.

What are our chances of getting my husband a visa?

Also, is a credit card, U.S. bank account and voter registration enough proof of domicile?

Thanks so much for the responses and great info! This forum is great!

You should be alright as long as your parents make enough money. However, if it bothers you, you could always return early and find work. The income you make counts immediately towards the I-864 and you may not need a co-sponsor after all. I did this because we were dead broke and needed cash, the I-864 aside. :P I still ended up needing a co-sponsor because I was about a 1000 dollars short or so, but it did feel better to add my own income to the pot. The only thing that sucked was the seperation which was about 5 months. We have a young daughter that is now 20 months, so been there done that too.

Frankfurt is a leinent embassy, so you shouldn't have much of a problem getting a visa for income reasons if you have good co-sponsors. There are some embassies that will not permit co-sponsors period, for example.

When they ask for domicile, I assume that you will be living with your parents for at least a short while after arrival. You should use their address. The rest is just supporting evidence.

Make sure you go back and file taxes for the past three years, even if it is for nothing.

  • 1 month later...

Do I need certified copies of marriage and birth certficates for the interview? We will have original copies with us and we would like to give them photocopies, is that sufficient? If not, where can I get certified copies last minute in Germany? Interview is Monday in Frankfurt. Would appreciate a quick response. Thanks!!!
