I'm a American living and working in Tokyo and have a Japanese wife (less than 2 years). We plan to relocate back to the states so we're in the process of filling the I-130, I-864, DS-230 forms. If I don't have a job lined up back in the states, what's the best way to establish domicile and to fullfill the financial requirments? Should I use my parents address in the states as my domicile, and have them be a joint sponsor? I have just enough money in my bank accounts to meet the finacial requirements, but I won't have a continuing income until I find a job. Is anyone or was anyone in the same situation as us. Your experience or advice would be much appriciated. Thanks in advance.

All you said is right on. Use your current address as mailing address, and indicate country of residence in the US. DCF processing is familiar with these type of situations, so it shouldn't be an issue.

Income: do line up your parents as joint sponsors, but remember some things:

1. You have to fill in an I-864 yourself since you are the petitioner. Your parents will fill in another.

2. Get a hold of your tax transcripts. If you have not filed, do it right away (it can be done through the Consulates sometimes) or check if any exceptions apply to you and include a letter indicating why you didn't need to file.

3. Everyone knows I'm insane, so I hope someone with a more level head chips in with more advice.

If you've left any bank accounts or credit cards open and/or kept your driver's license up to date, that helps with domicile as well.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
