So if I read this a-right – this woman entered the country illegally as a child in tow with her family who were denied asylum status. She then grows up, marries a USC, has children with him and tries to adjust status legally based on her marriage. And the deportation is based not on her LPR application, but on a failed asylum application on the part of her father. Hmmm....

I don’t think her family has much of a leg to stand on here, but IMO there should be some sort of dispensation made for her at least.

so if she's allowed to stay, there is no teeth to the law then huh? sounds to me like she was duly processed and now faces the consequences.

Punishing children for what their parents do is wrong.

I have a friend who was told to leave Germany upon turning 18 (his mother was German, but immigration laws were a bit more restrictive then if your dad wasn't). Luckily for him, the US agreed to take him. (His dad had died in a car wreck.)

My great grandmother was here illegally (from Canada, no one cared 100 years ago). It would be a real pain if they decided to deport her 5 years ago. Or decided to deport some of my family (they don't have birth certificates due to city hall burning down 50 years ago).

The real reason Uscis acted in a case like this is because it's easy and makes it look like they're doing their job. Now if they would just do something about the flood of illegals from the south then I might be impressed. This is nothing but a publicity stunt.

Wow this is so unfair! What did she understand when she was 12? Was she really given a choice or asked if it was right or wrong? That's not how it should be...it's just not right

If she was brought here as a child and grew up here thru no fault of her own, it is rather natural that she married an American. I don't see the point of sending her home under those circumstances, but I don't know the whole story.

Im a little torn. I feel for this woman and her family. It is not her fault she arrived here illegally.

But, she is here illegally.

If she was an illegal alien, how did she work and pay taxes?? :whistle:

Sorry, but she was trying to adjust her ILLEGAL status and got caught.

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

The USCIS has no leniency to show. An immigration judge might but the agency doesn't. She entered illegally. That makes her ineligible to adjust based on her marriage to a USC. The asylum claim, if successful, apparently could have fixed that but it wasn't successful. Hence she cannot adjust status. That's the law. Again, the agency cannot change that. A judge might be able to consider mitigating circumstances but that apparently failed, too.

Lord knows I ain't no fan of the USCIS but I don't see what they could have done differently here.
